We ran into a problem with the estimated taxes on your grandmother's house. When the closing attorney checked title and taxes the information shown by the Madison County Tax Assessor's office showed that the property was assessed as non-homestead.
XXX's office used that data in calculating the prorated rent credited to your grandmother from the seller for the time that the seller owned the house in this tax year.
After closing the seller told us that they had filed for and were granted homestead status on the house substantially lowering the amount that should have been credited to your grandmother from the seller. XXX's office checked with the tax assessor's office and confirmed that the property had been granted homestead status but that the change in status had not been recorded in their records when XXX's office did the title work.

I recall that XXX covered the homestead status during closing. The seller didn't mention that they had been granted homestead status then. If they had we could have made the correction then. I think they were involved in conversation and it didn't register with them that everyone was working with incorrect data from the Tax Assessor. I've been doing this for almost 12 years and his is the first time that we have ever run into this. Had we had closing a few days later the tax records would have been updated and correct.
