Protecting Yourself From Mortgage Fraud

According to the FBI, mortgage fraud is still on the rise. Even with lenders  tightening underwriting guidelines and new laws that have been put in place to protect consumers, mortgage scams are up by 20%. And listen to this...Mortgage frauds are now estimated to cost between $4 - 6 billion annually!

These frauds have different "faces" and today's most common types of mortgage fraud are the ones targeting home owners that are behind their mortgage payments.

Here's a 3 minute interview from the Today Show that will help you identify and avoid common frauds.

As far as your mortgage paperwork, make sure you always read the documents and understand what they mean. If you don't understand and have any questions at all, make sure to ask until you get true clarification and feel comfortable signing it.

American ingenuity knows no bounds legal or otherwise. What we are seeing is that if you can make a "buck" anyway you can...go for it.....This message has to be challenged as the youth of today are bathing in it......Not wise to base everything we do on money......

Joseph: I can't really see how appraisal fraud would be up. Unfortunately, scammers find a way to do things that we could never imagine would be possible. Hopefully you're correct.

Michael: I definitely see more of a need to hire attorneys. That's sad though...

Tonny and Suzanne: Is there a chance we're related? I'm originally from Brazil. My husband is a "Marriott". No relation to the hotel chain....Oh well...I'll keep digging... = )

Richie: I worry about the youth. The message they're getting is that money is not necessarity tied to very hard work. It wil take parents bringing up kids on high values and standards to change this.

Maria - And this is why underwriters are so diligent in their review of documentation.  I am so sick of reading posts by ignorant Realtors complaining about the how ridiculous the loan process is. 

While I agree that some of the lender overlays are a little irritating, I for one am so glad that we are finally back to full doc underwriting.  It's with less documentation and less verifications and risk assessment that fraud becomes so rampant. 

Sleaze bags will always find the loopholes and it is because of this that underwriters and lenders have to be so diligent during the loan process.

Thanks for alerting everyone to these scams.  As my father used to say, if it sounds too good to be true, it probably is.  People will always pray on the naive and gullible.  We need to figure out how to prevent this and your post is a great start: educating folks.

I am surprised that fraud is up but I agree with the comment above that the reporting of it is probably whats up.

Donne: As much as it is harder for us mortgage originators to deal with so many overlays and the fact that nothing is uniform between lenders these days, I have to agree with you (I do have to say that there are a few out there that are just a little bit too much...).

#12: Agreed. Education is certainly the key here.

Chuck: It's hard to say if it's really that much higher since we're dealing with the media. But I woudn't be surprised.

Hi Maria. Isn't a shame that we have an element in our society that preys on situations by way of fraud. I hear less about the type of fraud mentioned in the report, but more of other types regarding short sales.

I always think "If these crooks turned their superior intellects to positive use, what a fantastic world this would be."

The whole mortgage mess might not have happened if consumers had understood their loan documents in the first place. Even sophisticated consumers can't always understand the legalese in documents - everyone needs to have a trusted attorney look at paperwork before they sign.

Excellent advice. In Florida the state passed a law in 2008, making it illegal to have someone sign over a deed or collect an upfront fee from anyone delinquent on the mortgage payments.

I can't believe that mortgage fraud continues as such a high rate! I wish the lenders would do the right thing and help us get out of this mortgage mess... However, it looks like the greed goes on!

P.T. Barnum was right. All sorts of scams are out there. This is just one of many.

Don't EVER expect help from a big lender with a national presence. Word to the wise.

With our highly mobile society, it is easy for these fraudsters to move on and do it to someone else. Hopefully, one side effect of the internet is that they cannot stay as anonymous as was once possible. There must be a site somewhere to report a ripoff artist, if you were a victim.
