Knauf Agrees to Remediate 300 Homes!

On 10/14/2010, a manafacturer of defective drywall agreed to perform remediation on 300 homes as part of a "Pilot Program".  This agreement was reached as part of a settlement between the plaintiffs of a class action suit and "Knauf Entities". 

 

Many aspects of this agreement leave homeowners at substantial risk during the remediation process.  There are clauses included in the agreement that provide reimbursement to Knauf for a significant portion of the remediation costs! Yes, you may have to pay them back!

 

Identification is the key to participating in any settlement.  If you or someone you knows has identified a home that is positive for defective drywall, you must follow MANDATORY inspection protocols in order to participate in this or any future agreement with Chinese Drywall manufacturers.

Fines Levied For Purchasing A Home!

Many Home Buyers are closing on homes thinking they have negotiated a great sales price only to find out that they owe THOUSANDS in fines to local Code Enforcement Agencies!

 

Consider this scenario:

 

You made an offer on a foreclosure property at an awesome purchase price.  The bank accepts your offer and you go to closing and purchase a great home at less than 50% of what it cost to originally build the home! 

 

Sound good so far?  But wait, there's more!  Not only do you get a great deal on the home purchase, but you also inherit all the CODE VIOLATIONS performed by the previous owner!  These violations add up to THOUSANDS of dollars in fines that YOU get to pay! 

 

What Code Violations Could Exist?

 

  • Improvements made WITHOUT a permit (lanai, garage, porch, etc. converted to living area)
  • Electrical alterations made WITHOUT  a permit (sub panels, outlets and power sources to non permitted living areas, power sources to non permitted secondary structures, etc.)
  • Secondary structures added WITHOUT a permit (barns, sheds, guest house, carport, etc.)
  • Pool/Spa additions WITHOUT a permit
  • Additional baths and/or kitchens added WITHOUT a permit

In a buyer's market like today, many home buyers do not take into consideration that some of the alterations and/or additions to the property were not properly permitted and/or inspected.  These Code Violations automatically become the responsibility of the new onwer!

 

This scenario is being found throughout counties all over Florida.  Therefore, these counties are now encouraging Home Buyers to obtain a Code Property Inspection when contemplating a purchase.

Great information on the Chinese Drywall, Jim.

And those Code Violations!  If the City or County has not yet made discovery, nor filed a Lien on the property, it may get by the Title Company.  Always worth verifying!

Thank you Fred.  You are right.  The fines piled up on a violated property can cost thousands to the new home owner!
