On The Road Again...

Well, I hate to say it but I have no choice in the matter.  We are on the road again...moving!  We just moved six months ago! Our boxes were finally cleared out, pictures not yet hung.  Why are we moving?  

Well, you see, one night I was running a little pre-foreclosure search in our MLS and much to my surprise, my commercial building was in foreclosure!  WHAT? I immediately began my search for a place to call home. I was lucky to find another location that suited our needs and we signed a lease Monday.

The Lesson To Be Learned...

House with timerTime may be running out for you too!  You may not be in need of commercial pre-foreclosure stats but if you are renting your home you may be!  Be sure to find out as much information about your landlord as you can.  How long have they owned the home? What are their long term plans for the home?  Do they have any intention of moving back into it?  Most importantly, are they making their monthly mortgage payments?  Did you know that it is possible to see if your home is in pre-foreclosure, foreclosure or even auction status?

You also need to be aware of your rights as a tenant.  Be sure to be informed of your legal rights when your home is in foreclosure status. A good place to start is on the State of California's website where you will find a handbook of tenant rights.  According to the TenantsTogether.org website over 15,000 tenants in Placer and Sacramento Counties were affected by a rental foreclosure in 2010! That's a lot of people on the road again!

That would not be a great discovery! Sounds like you took it in stride! It's tough being a tenant, commercial or residential, in the real estate market today.

That's such good advice!

I know of a couple who paid rent for nearly a year on a place only to find that the homeowner was putting the money in her pocket and not bothering to make the payments.

Residential: A family member was recently served "notice of rent increase" on his month-to-month rental for the condo he lived in.

I said, "wait a minute". We researched the Public Record (Scottsdale, AZ). Not only was the Owner heading into Foreclosure, she had not paid the Condo Fees for many months.

She was literally pocketing the Rent Money, and now she was getting greedy and wanting more.

Instead, Family Member showed her what he had found on Public Record. He offered to pay less than One-Half of the rent he had been paying (from $2600 down to $1000).

What choice did she have? He got his rent cut by more than Half. He moved out 7 or 8 months later.

Dawn - You're right, it wasn't a good discovery. I loved my office and had just moved in!  But, I'm not one that is comfortable with the "unknown."  I wasn't going to sit back and wait to see how long it took before we actually were kicked out. I needed a place to run my business so I had to act fast! 

Marte - That is such an all to common occurrence which is why I felt to post this!  Our landlord wasn't paying the payments when we moved in!  Grrr!  It is an unfortunate time when people sometimes only think of themselves!

Debbie,  good information!  I will have to say this is not something the average renter thinks to look into. How frustrating it is as a renter to know you are making payments, and the owner is "bothering" to.  Happy moving day.....again!
