The lawsuits filed today against the Bank of America are the first in the Nation, and are based on fraud allegations against Bank of Beelzebub in their loan modification programs.

"The bank is accused in the Arizona and Nevada lawsuits of misleading consumers about requirements for the modification program and how long it would take for requests to be decided. The bank provided inaccurate and deceptive reasons for denying modification requests, according to the suits."  By Karen Gullo, Bloomberg

 

Hmmmm . . . you don't say!?!  The bank provided inaccurate and deceptive reasons for denying the loan mods?!?

NO KIDDING!!  What the "hell" do you expect from the Bank of Beezlebub?  Honesty?!?  Helping home owners remain in their homes vs. foreclosing?!?  Muwhahahahahahah . . .

Of course, these are "allegations" {wink, wink} and, as with any good defense counsel -- they'll make a TON 'O MONEY defending the spawn of Lucifer . . . if they were retained to do so.

As if we (REALTORS®) DIDN'T KNOW THAT THIS GOES ON IN THE MARKET!  WE'RE IN THE TRENCHES EVERY DAY, HEARING THESE STORIES!!  

The States of Arizona and Nevada have sued based, among other things, on Bank of America's BOTCHING the home-loan modification programs

OOPSIE!!

Can't wait until the States' Attorneys CALL THEIR WITNESSES!!  I'm sure the home owners that got screwed will be lining up to bear testimony.

We know:  The banksters make more on the foreclosure and reselling of the property.  The examples of FDIC's work out deal with Indy/West One are here.  I'm sure the same deal is available to Bank of Beelzebub.  And if we've forgotten "how" the banksters profit in foreclosures, just watch this for a refresher.

Great post, Carla and congrats on being featured on the main AR page too!  

As much as you detest BOA, I hate to hear this--and this is the first I'm hearing of this.  They are headquartered in our beautiful city and I SO wish that they would pull their act together and be the wonderful presence in the industry that they used to be.  They are not doing NEARLY enough to improve their reputation and it seems to be getting worse by the day.  I have no doubt that other states will follow suit in this.  Unfortunately there's nothing we can do but, sit by and witness the pain the homeowners are going through with their failed loan mod apps and all the while watching our stock values fall by the minute.  Ugh!  Not a pretty site for us locally, muchless nationally!

OMG, I TOTALLY forgot to tell you!  I was in a bar on the ship one day last week and a Judge __ something show was on and YOU won a case that was heard by him against a tenant!  All I could keep saying was, "OMG, I know her!"  What a TRIP!  I never expected to see YOU on the cruise with me!  LOL

If the basis of challenging a foreclosure is based on the fact that the homeowner really wasn't in default, the vast majority of challenges would lose.  While those do happen on occasion, in most cases the borrower is indeed behind in their mortgage payments.  But if a challenge is based on the fact that the bank mishandled the processing of HAMP, HAFA or PFS documents, watch out. 

Many banks sign on to programs voluntarily but after that they are obligated to participate.  They have been losing documents that arrived FedEx and signed for.  If the mishandling of modification documents or the modification process becomes a recognized valid way to fight foreclosure (before or after the fact) then things could get very interesting.  I wonder if an attorney could chime in on whether this might be a possibility.

Hi Fernando . . . I never understood that either, how those advertised commissions could be "negotiated" by the banks.  I always thought that was bogus, but they did it.

Hi David . . . I hope this gets some "face" time on the news . . . I doubt it.  Media focus on the crimes all right . . . but only a certain type.  "White Collar" crimes, which have affected millions, get buried. 

Hey Jim -- I look at it this way, the attorney general in the states that are filing suits get paid anyway, whether they would have filed this, or something else.  The tax payers ARE paying, but they pay their salaries anyway.  So . . . I'm glad they are doing this.  BofA will have to hire they own Dewey, Cheatum & Howe defense firm.

Hi Kate . . . Thanks for the re-blog!  I don't know the state laws.  They are being sued for, among other things, fraudFraud can be civil OR criminal.  I don't know if they're suing on criminal grounds.  They should be.  Not sure if you can buy your way out of settle criminal charges.

I am SHOCKED that BofA is being treated in this manner. Seriously it was only a matter of time for some group to take action. I will watch this closely to see how the plaintiffs are treated.

Carla - The articles you posted talk about heavy fines per incident.  They do not discuss the issue I raised in my comment - whether the behavior of the banks could be used as a basis to challenge a foreclosure action itself. Maybe a different twist on what you posted.

I am glad that you did post what you did, because it shows the legitimate heavy hitters in some state government are taking strong actions.  (It is confusing that BOA's stock price went up after these suits were filed.)

Hi Brent -- The states of AZ and NV are the plaintiffs, and apparently in the AZ civil suit, they are seeking damages and restituion. It will be interesting to see how this will play out.

Hey Dan . . . Oh, now I get your comment.  Thanks for the clarity.  These are such legal questions, and I'm sure not easy to answer.  Perhaps the issues in the robo-signing are different?  I wish someone would post the complaint on Scribd or something.

This is funny-as in those classic tragic comedies of Shakespear where everyone dies in the end because they were all...possessed by demons! It is so sad how many people have been sucked into this demonic hell-hole and had their lives turned topsy-turvy. And it is also disturbing how some politicians are SO in bed with these banks, and how our US policy thanks to those disturbing sleep-overs have screwed us all. I saw it coming years ago. It is so wrong. And now the lawyers are going to help-oopps-profit from it, too? This is such a sick, twisted circle.

Carla, thanks for posting the complaints.  Interesting read, especially the part where bank employees were told say anything to get the borrower off the phone.  Isn't that what we've always thought? Bend Over America what a hilarious nickname by Russel #46!  True we've all been screwed by BoA, but hopefully these lawsuits will force BoA to comply with HAMP guidelines in the future.  And possibly those who have lost their homes to foreclosure can be remedied.  Is that too much to ask? 

It's time for BoA to get back what they've been dishing out.  Bend over BoA this Christmas.  I can hear the bells ringing now!  Congratulations on the well-deserved feature!
