Agents should and are required to present any offer in a timely manner to the seller. Recently, I had an agent who did not present a valid offer due to the property disclosure not accompanying the purchase agreement. Understanding the importance of the property disclosure, to both parties it should not slow down the process. In Louisiana, we used the same purchase agreement through out the state. The last page has a require field. The field specifically state whether the property disclosure is attached or not. This changes in 2011, where this field is not included in the new purchase agreement. Submission of the property disclosure does not mean the purchase agreement is not a valuated contract.
Realtors in Louisiana are required to present the purchase agreement immediate to the seller. This contract may have lost its validity if the time constraints were not met.
The reason why we presented a purchase agreement without the property disclosure, one was not present on the MLS. I had asked for one and none was provided. The agent is an experience agent. I would have been more focus on presentation of the offer and deposit checks.
