Florida Judge Roger Vinson Rules Key Components Of the Mandatory Buy-In Health Insurance Mandate Unconstitutional January 31, 2011

An excerpt of Judge Vinson's conclusion:

 

"For the reasons stated, I must reluctantly conclude that Congress exceeded the bounded of its authority in passing the Act with the individual mandate. That is not to say, of course that Congress is without power to address the problems and inequities in our healthy care system. The health care market is more than one sixth of the national economy,


and without doubt Congress has the power to reform and regulate this market. That has not been disputed in this case. The principal dispute has been about how Congress chose to exercise that power here.

Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void."

I'm always surprised when those well off begrudge health care coverage to those who can't afford the coverage, or might have a pre existing condition, or poor choices in health plan carriers.

Hi Lana...It will be interesting to see what the U.S. Supreme Court decides.  

Watching TV this evening and seeing a Vietnam vet that had his health insurance cancelled because his wife sent a premium check that was short by two cents was a bit chilling.  This man has multiple myloma, a devastating form of cancer that a friend of mine died of, and the company leaped on a chance to rid themselves of him.

The public outcry became too much and the company finally renewed his and his wife's policy.

I have a feeling that many of the things currently in the Health Care Act will remain.
