Lead base paint disclosures - use them or pay huge penalties!

Coldwell Banker agents are now required to use new lead base paint disclosures, WHY?

HUGE FINES!  Apparently there have been audits and huge fines charged to agents who did not use the lead base paint disclosures when they wrote offers or posted listings.

The fines are in the range of $25,000.00 per line. Signatures, dates, etc. are part of this investigation.

The important issue here is to utilize the addendum's that are necessary.

Any home or condo built prior to 1978 is required to have a Lead Base Paint disclosure, a Lead Based Paint pamphlet, and a document signed by the seller and the seller's agent included on the offer. SELLER must sign first.

This is a FEDERAL LAW, PUNISHMENT BY FINES.

Please make sure if you are listing with an agent and your home or condo was built prior to 1978 that this document has been reviewed by you the seller and signed, and that your listing agent has signed it as well.

Are all of you in the rest of the 50 states aware of this as well?

why would any agent not fill out this easy form...hand out the booklet...get it signed...and move on. Just silly.

Hi Karen --- the entire state of California requires a two page disclosure completed and signed by the seller with additional signatures from the buyer, listing agent and seller agent and acknowledgment of receipt by the buyer for homes built before 1978.

In Colorado they have taken it one step further and not only due you have to fill out the form but contractors have to be licensed by the state to remove or work with houses with lead based paint. They have made it just like asbestos, you have to dispose of it as hazardous materials at a huge cost. Investors are shying away from pre 78 homes. Call your congress man before this happens in Florida.

Apparently an office was fined in the Carolinas.

Roger - IT WAS A TYPO...

Michael, CB must have had an issue in one of the Carolina's.  We now have new documents from legal that have to be included in all of our listings...might not have been mandated to you yet.

Troy, We have lawyers who are looking over everything, but I will pass your suggestion along, Thanks.

Yes we do that here in Oregon.  Got to get those disclosure statements signed, not sure why some agents don't do it.

I'm not sure either, maybe they are just not educated or supervised enough.

There sure is a huge fine if they do not.
