Desperate Acts Dig Deeper Holes

Next to health issues, financial woes probably cause more stress than any other life altering situation.  The other day, Cindy in Indy wrote a post about a homeowner that had rolled their car into their mortgage.  For me it was deja vu.  Not for me personally, but someone that I know had done the same thing.  At the time, my question to that person was:  Do you really want to spend 30 years paying for a car?

So when I read Cindy's post, I wondered what prompted that owner to make that decision to roll the car into the mortgage.  Were they behind in car payments?  Were they just trying to consolidate debt? Did they feel that was their only option?

Acts of DesparationThere are just a few other things that come to mind when I think of desperate acts that people take in the realm of homeownership.

DISTRESSED HOMEOWNERS (Foreclosures and Short Sales)
This one is an obvious act of desperation and there may be many, many reasons why sellers fall behind in their mortgage including job loss, other loss of income, illness or other crisis.  I don't know what I would do if I were in many of these homeowners shoes, but I'd like to think that I would still be the rational person that I think that I am today.  Having said that, it seems that I would realize early on that I am in a situation where I need to take action and move quickly.  Sometimes homeowners see it coming and standby and take no action.  Other times, they are caught totally oFf guard.  Ultimately their desperate act is that they did not ACT at all and now face the stress inducing process of foreclosure.  With loan mods, short sales, deeds in lieu of foreclosure, etc. there really is no reason to sit idle by and let the situation consume you.  It's unfortunate and I have the utmost compassion for you.  But something tells me that most rationale people would give this same advice to people who they know are distressed homeowners. Now it may be time to follow your own advice.

LEASE PURCHASE AND LEASE WITH OPTION TO PURCHASE BUYERS
In some areas of the country, I've been told that lease purchase and or lease with an option to purchase is the only affordable way to own a home in some cases.  But here in the Metro Birmingham area, what I hear most often is this:  I want to do a lease purchase so I can take some time to clean up my credit.  In my mind, I'm always thinking that this class of buyers want a house so bad that they are willing to lose their downpayment not knowing whether they will ever own the lease purchase home.  I'm not saying that it can't happen.  But why not clean up your credit first and then set out on a quest to purchase a home.  It may just make sense to rent while you straighten out any credit issues.  Besides when you finally do clean your credit up, there may be another home on the market that you'll love even more.

The point here is that people will often force an action to make sense simply to justify their desire to do something.  I'd venture to say that this plan will almost always backfire.

Good post Charita, and you cover several desperate scenarios! I'll only address one, rolling the car into the mortgage. I doubt that the homeowners situation was desperate, rather it may have been with the advice of a financial professional i.e., accountant, or financial planner. It depends on how much equity they had in the home, and their tax bracket. As we know, mortgage interest is still deductible and interest on a consumer loan is not. Going back a few years when lenders were doing 125% LTV, this most likely would have been ill-advised.

I can see your point of view if now, because of the refinance, or HELOC, there's not enough equity to sell the home.

Thanks Clark.  It may have very well been the advice of financial advisers.  It's not advice that I would have taken, but it may have made sense for them at the time.  LTVs of 125%.  How ridiculous is that?  Only a lender can rationalize that and make it sound attractive to a consumer.

It is so true that many homeowners (like Valerie said) are like an ostrich and have their heads stuck in the sand! It isn't fun facing up to problems and for many stepping back and listen to a neutral party analyze the situation might be the way to go!

To those type of clients, I encourage them to remain renters and let somebody else worry when the hot water heater breaks. It's expensive to be a homeowner if you are not prepared.

I agree Lori.  Not everyone is prepared for to take on the challenges of ownership.  In addition, the terms of the lease purchase may often be ignored if there are even minor repair issues.

Hi Charita. This a great post! If only people would think about all their solutions and the future before they make those desperate actions. Perhaps, they convinced themselves at the time to act on their particular situation. But adding a car to your house note.  Never,Never, Bad Advice!!

You're right. The situation at the time has to be considered. Some people use home equity for vacations, recreational vehicles, etc. and all are encouraged by lenders.

Hi Charita - over the past two years I've been called in by responsible agents to help owners get their property somewhat ready for sale while these homeowners were in the foreclosure process - my observation has been that these folks would rather live with a "victim" mentality and let the house foreclose than to step it up to get the property sold (in one case, they probably would have broken even - not even a hit to their credit score!).  It's a shame when people get so caught up they can't see the forest for the trees.  Great post!

I have seen people with some equity refinance their home every year to pay income tax....I've seen equity pay for cars, college educations, unnecessary improvements such as an inground pool, etc.

Peggy I know that happens a lot.  I guess you just never know what people's real motivations are.

Susan I can see paying for college and the pool as an improvement to the home. But stuff like cars, vacations, boats, income tax, etc.  I don't get it. Funding kids college with home equity may not be sound advice, but it's better than those other things that have been mentioned.

Really Joe.  Was he planning to keep the 1st home?  If so, I suppose he could have done a blanket mortgage, if allowed.   I know people do that with cars, but with homes.... I've never heard of that.

A very long time ago and long before I was in real estate - I bought into the lease option to buy out of ignorance. $10k down and 2 years worth of payments when the owner went bankrupt and I didn't have the down payment to get a loan on my own ! PAINFUL and expensive lesson for me...
