Did you know that Florida is 1st in the Nation for fraud and foreclosure and Citrus County is 7th in the nation!!  So much fraud has been going on around here, we wanted to share a story that happened to us recently.

We have a listing that is a short sale, we received a call from a local business man stating he wanted to do a deed in lieu  of foreclosure.  I explained that he was not the lien holder and only the lender go to that so he said let me explain what I want.  I want the sellers to sign the deed over to me and keep the mortgage in their name.  I explained that is fraud and most mortgages have an acceleration clause that would kick in at that point.  Have no fear, he assured me that most banks to check into this kind of stuff and he had already done this on several other properties.  At this point I was thinking are you serious.  He then proceeded to tell me that a Realtor friend of his told him by law I must present all offers to my clients.  I told him I would be happy to do so but that I would also recommend my clients not take the offer and talk to their lender of lawyer.  When I called him  back to say that the sellers are not interested in his offer, he actually told me it was because I did not know how to present it the correct way.  Regardless of how I presented it, It is fraud and I will have no part of it.

I think we all need to pay attention to this kind of stuff going on.  I am also hearing about people or companies that are putting in offers for $100s of thousands of dollars over asking price, having their appraiser do the appraisal and their title company close the deal.  I know our clients want the most for their home, but if you do this you will get caught!!

Great post. There is so much fraud in the country and you are right - Florida is bad! - that we must all be on our guard at all times. I talk about this a lot on my radio show - talking of which.....

Thanks for the heads up. I am not familiar with Short Sales but will read up on them. Do you have any references to what a short sale is?

wahoo crystal river, I used to go there all the time to the withalacocee or however that river is spelled. Fraud is rampant in this state always have been. Like you said watch out everyone.

Wow, it amazes me to this day the number of people who try to beat the system regardles of the legality. Smart move to stay away from that deal.

Where is it written that you must present an illegal offer???  Where does this garbage come from.  What we must do is follow our client's legal instructions. 

We do not have to take orders from buyer non-clients and we do not have to participate in fraud.

In my area of California we have the problem with people giving offers $100,000's over the asking price. We get faxs everyday like this. And now we have a problem with people finding empty homes and putting them on craigslist for rent. They walk the renter around the home and ask for a 1000 dollar deposit and you never see these people again. What a mess.
