Tattoos-Is it LEGAL to discriminate against them? YES!

A report I just heard says, SOME apartment complexes have been denying applicants because of heavy tattoos and body piercings.  According to the fair housing officials with San Antonio city government and the Federal government, it may be unfair but it is NOT ILLEGAL unless the tattoos have religious or racial significance.

 As a long time Realtor, I was surprised by this, because Fair Housing is something I have been taught and practiced for many years.  I personally do not like tattoos or piercings  (except pierced earrings) but never dreamed someone could be denied because of them.  This is a very interesting story aired on WOAI News and the public response has been very engaging.  Everyone has an opinion on this.

The complex's policy is to ban anyone with head or neck tattoos, or tattoos that cover more than 40% of the arm, eyebrow or tongue piercings, more than one nose ring and more than five earrings.  "Grillz" over the teeth are also included.

The apartments are owned by a California company that has the same policy for all their complexes.  Would you like to see the same policy in your area?  DO YOU THINK  this is the way of the future OR will it just go to court?

   Wow, I had no idea that was legal.  I think most people would be affraid to discriminate against this even if they knew it was legal to do so.  Reason being, it just sounds like a law suit waiting to happen!!  Good info to know though.  Enjoy your day.

Man, some of the things companies will do just to keep some people out. It's pretty scary! Tattoos aren't that bad. Well, we'll see what happens.

Thanks Rian, for commenting.  Yes, it does seem like a lawsuit waiting to happen but I can understand why companies would do this.  Ones wanting to attract certain kinds of people to their properties and for now they have the right to.  We'll keep watching this situation. 

 Maybe some folks should rethink the fad of tattooing their bodies.  I 've seen lots of news articles about taking the tattoos off with laser and the people getting 1,2,& 3rd degree burns and permanent scarring too.  Thanks again for the comment.

 

HELLO, Mark, thanks for the comment.  Some times it is hard to lease a place and for some folks it is very difficult.  Maybe this will cause some people to stop gettting tattoos where they can be seen easily.  It is something to consider.

That's true, Sam.  According to the article, they have several properties in several different large cities and they have the same  policy at all of them.  Thanks for the comment.

Ridiculous. This is segregation of beliefs and discrimination at its finest. Im from Texas, ex military and believe in the right to show your true feelings whether in ink or on paper or whatever crap these Californian money hungry expletives are trying to funnel the everyday simple minded people like yourselves into NOT believing. This is the reason why brave men and women put their lives and more on the line. Get over yourselves your righteous judgmental sad little people. Welcome to TEXAS. Think I'll go get a new tattoo.
