Procuring Cause: Are You Buying Real Estate in San Diego?

If you are a Buyer and are buying Real Estate in San Diego, it is not necessarily in your best interest to use several Realtors to find the right property.  In doing so you could end up causing commission disputes among real estate agents.  Commission disputes are what is referred to in the Real Estate industry as "procuring cause."

The Realtor who made it possible for the buyer to purchase that San Diego home and earned the commission is typically the procuring cause agent. That procuring cause Real Estate agent may not have had anything to do with writing the offer, negotiating terms, and tending the transaction through close of escrow. The procuring cause agent is often the agent who showed the home to the Buyer first.

All states and Realtor associations have their own guidelines regarding procuring cause and those guidelines can be interpreted in many ways.  That is why there is what's called a grievance committee, such as is the case with the San Diego Association of Realtors, to rule on such disputes.

So,,, if you are working with, and have established a relationship with a Realtor, be honest and upfront with other Realtors.  When you speak to an agent at an open house, make a sign call, or ask another agent for information be sure to let them know you are already working with someone.  With that being said, if you are working with a well qualified Realtor, someone like Allen Meredith, you won't need to call other agents for information.

In Vriginia procurring cause may not be the agent who showed the home first.  We have an entire worksheet that shows the pieces of procurring cause and most likely it is the agent who wrote the offer, negotiated the terms and got the home to closing that will be the winner in a grievence committee hearing.
