Pay Off Request - 14 days for a home going to auction in about 1 month!

I am so frustrated because I have been working on a short sale for months.  When I first got the listing the bank was great - they were calling me for updates every couple of weeks.  It took about 5 weeks but I got an offer on the property. 

Upon receiving the offer I did a complete package including the financials, HUD, Hardship Letter, BPO and all the additional backup I had to prove the hardship.  I repeatedly called for weeks and no reply.  When I finally was able to speak to the rep. they told me they never received the offer - so is submitted again. Still no reply.

During this whole ordeal the buyer got tired of waiting and moved on. I just got another offer and I need to resubmit everything again and I called for an updated payoff so I could have as accurate of a HUD as possible.  Since I was now dealing with customer service they did not want to release any information because they said my authorization to release information was only good for 2 months!!!

Needless to say that did not go over well with me as it is not my fault they are dragging their feet.  Now they want me to have a new release signed and faxed back to them.  Errhhh!  So after speaking to a manager they agreed that they could talk to me - but even after going through all of that they are telling me it will be 14 days before I can get a payoff!  What - are they nuts?? 

I will submit my new offer with an HUD that has numbers that are hopefully accurate - but I have no idea how much they have added on for foreclosure fee's since when we got the first offer they had only missed 1 payment. It is not 5 months later and they are still dragging their feet.

There has got to be a more streamline way to get these done!

Well that certainly sounds frustrating. I've stopped lsiting short sales this year for exactly this reason. The lenders are sooooo slow in making a decission.

I am not sure if there is a streamline way of doing this, I have had the same frustrations.  The one I am dealing with right now has been going on since 6/1/07.  I started with first missed payment and now it is getting ready to go on the auction block and no approval yet.  (dealing w/2mortgages)

I was in a similar situation several months ago. I went straight to the top (asked to speak with the manager/supervisor of the loss mitigation department) and immediately received a call from the negotiator. They were very eager to wrap up the deal when I let them know the buyer was about to walk. Best of luck and keep doing what you do.

Short sales can be very frustrating if you let them.  I would suggest asking the title company for a copy of their blank payoff demand.  Find out the address to send the payoff demand to.  Either overnight the payoff demand (Fedex, UPS, etc) or send it certified mail.  I would include a cover letter with the payoff demand explaining the sense of urgency.  How will the bank/mortgage company look to an attorney if they are the ones holding up a stupid payoff demand and that was the reason for someone losing their home to foreclosure.

Lenders are under a lot of scrutiny right now with all the foreclosures going on.  You need to hold them accountable.  They could have some liability here.  World Savings/Wachovia is the worst company in the world for trying to get a quick payoff demand.  They usually want 10 working days.

I have been trying to get a pay-off for 3 months. You wonder what does clerks are thinking. Maybe it is not such a bad idea to Fire all these CEO'S. except they should get paid $000 for doing a lousy job.

Eric - I believe would need the seller's authorization with all of the privacy laws that are out there - but if you are resourceful enough to get it without their permission - I would think that who ever gives you the information would be in more trouble then you asking for it.
