DANGER, WILL ROBINSON!!!!. . . .GET TO THAT NEW HOME BUILDER BEFORE THE BUYERS WHO "AREN'T INTERESTED IN NEW CONSTRUCTION" DO!

This post inspired by a fellow ActiveRain member who posted about a buyer with whom they have been showing resales, who purchased a new home in the agent's absence.

THIS IS NOT ABOUT BUYER AGENTS REPRESENTATION AGREEMENTS.  We get that.  We know that, with a buyer agency agreement, you can sue the buyers for the fee if they buy anything without you during the period of the BA Agreement.  Fact is, few agents/brokers will sue a consumer for a fee.  Many agents believe that there is some magical force that, with a Buyer's Broker Representation Agreement, even where the buyer agrees to pay you during the period of the contract, THERE IS NOTHING AUTOMATIC ABOUT IT.

ONE THING FOR SURE, IF YOU ARE NOT IN THE CONTRACT BETWEEN THE BUYER AND THAT BUILDER, THE BUILDER DOES NOT HAVE TO PAY YOUR FEE.  Does that mean that they will NOT?  NO.  It simply means that they are not a party to your BA Agreement with the buyer.  Nor are you a party to the new home purchase agreement with the builder.  DON'T ASSUME!

FIRST OFF, KEEP IN MIND THAT NEW HOME BUYER BENEFIT FROM THE PRESENCE OF A BUYER'S AGENT WHEN PURCHASING NEW CONSTRUCTION.  I can't county the number of times a new home on-site agent has told a buyer that they "don't need" a home inspection.  OTOH, I can't count the number of defects  home inspectors have revealed during the home inspection.  I advise no less than a pre-drywall home inspection. 

THIS IS ABOUT PROTECTING YOURSELF WHEN WORKING   WITH A BUYER who doesn't understand that, although they

  • Say they're only interested in resales,
  • Say they don't want to buy a new home,
  • Say they believe that existing homes are better,
  • Say that resales are a better buy,
  • Say that they don't want to wait for new construction,
  • Say they need to move now and need a quick settlement.

The lesson here is one I've had a hard time getting agents to follow for decades.

When you are working with a buyer, always, always, always without fail, get them registered at every single new home site in the area of their search, and then go a bit wider and get them registered there too.

Engage buyers about new construction.  Tell them that you're going to tour new home site in their price range too so they have all the information about housing in the area of their price range/price.  Even if they say they're "not interested in new", don't blieve them.  Visit the new home sites, collect the brochures and register the buyers.

Beat them to the punch and get there, to the new home builder sites before the buyers do.

Protect yourself.

Home buyers are human.  They sometimes surprise themselves.  Even if they say they aren NOT interested in new construction, I can promise you that. . . .

IF THEY SEEE THE INCENTIVES OFFERED BY NEW HOME BUILDERS IN THE NEWSPAPER. . .

IF THEY DRIVE BY A NEW HOME SITE, THEY'RE LIKELY TO "DROP IN" JUST TO SEE WHAT'S THERE. . .

IF A CO-WORKER OR NEIGHBOR MENTIONS A GOOD DEAL ON NEW CONSTRUCTION. . . .

THEY MAY HAVE NO KNOWLEDGE OF HOW EASY IT IS TO BUY A NEW HOME. . . . .

All I'm saying is. . . PROTECT YOURSELF. .

Visit the new home builders.

Register your buyers.

Collect the brochures.

Give the brochures to the buyers.

Investigate quick delivery new homes, specs, inventories, fall-outs.

Suggest that you take the buyers in a new home tour to show them what you found.

In other words.

BEAT THEM TO THE PUNCH.

Lenn... you mentioned many things in your post that are very important... but one that sticks out in my mind is as follows:

"Beat them to the punch and get there, to the new home builder sites before the buyers do."

HA!  Having a previous working relationship with as many new home on-site builder reps is extremely important.  If you are driving around with clients, and they mention a certain builder... the fact that you can rattle off lots of information about that builder and that specific neighborhood is excellent reinforcement that you truly ARE the area expert in real estate.

@ Laurie in #15:  You mentioned about builders who prohibit late registrations.  I know several builders in the DFW market area who absolutely require that all buyers who sign registration cards upon visiting... that the specific buyer be entered into the builder marketing data base.

If... a specific builder rep puts an agent on a contract... and that agent is not mentioned on the registration card filled out by the buyer... that on-site builder rep will be FIRED.  I have seen it happen.  It is not the norm, but I have seen it happen.

This is so very true. I am sure that all of us in this biz have been burned at some point in our career from this. Always a tough pill to swallow.

I have helped many sellers short sale their houses that they bought directly from the builder without Realtor representation. They often complain that;

  1. They didn't understand the financing they got into.
  2. Didn't realize how small or dysfunctional their lot would be after the subdivision would get built up.
  3. Didn't understand how certain aspects of the floorplan would hurt resale value.
  4. Other problems that a competetent buyer's agent would have helped them avoid.

Bottom line: Always tell your buyer how important it is to their finances to have the right Realtor on their side.

Lenn, Great post. The easiest money I have made was to register a buyer with the new home builder. But I guided them through inspections and walk through inspections. Also I negotiated upgrades for them. But the kay is  you register your self and the client with you before they visit it.

Farooq.  Indeed.  That's my practice.  Register then fast and then help them through the process if they decide to buy new.

Dave.  Same here.  Builders will often offer bad lots with good incentives, but the resale on those lots may be detrimental to the buyers. 

Paula.  Wroking with new home sales for many years, I've learned to avoid these pitfalls.

Amen, Lenn! Been there, done that and shed the tears. Excellent idea! I also try to work with one sales person per community so I can make a phone call, shoot an email and fax in a registration form.

Evelyn.  Good for you.  It just makes good sense. 

I've had buyers tell me that they get a completely different response from builder reps when they visit with me than when they were going around by themselves. 

Buyers also have to be warned, don't visit builders without me and if you must, give them my card and tell them that you are working with an agent. 

Give buyers a few cards to keep.  Then hit the road and visit those builders.

You amaze me!  You are a spring flowing free with knowledge & common sense!  It is obvious that you learned from your mistakes [and I bet you also learned from the mistakes of others].  Thank you for you presence--you can always be found "standing in the rain."

Excellent points about homebuyers and builders.  I spent 25+ years in mortgage finance, and could write a book on buyers who fell for the "you don't need an agent" line; and the sucker punch, "we will pay your closing costs if there is no other agent commission involved."  A smart builder would not want to alienate the REALTORS® in his community--I've dealt with the tricky-dicks, and honest johns.  My experience is that if they attempt to avoid paying commissions to a REALTOR® legitimately representing a client, the the client better look out: more tricks are coming.

Some of the most honorable members of the housing industry wear the builder cap, and are forced to bear the insult of being in the same business as Tricky-dick.  We REALTORS® understand, and come to know the difference.  We just hope our buyers learn from others' mistakes rather than their own.

Fred.  Thanks for the kind words.  Actually, I didn't learn this lesson from "mistakes".  Early in my real estate life, it seemed natural to "know the builders" in my area, Maryland and Northern Virginia and I took a week, traveled around the beltway, visited every new home community in about 9 counties and got the basics, i.e., prices, home sizes, builders' co-op policy, reps, etc.  Keep in mind that this was BEFORE we had the MLS on the PC and before new homes were listed by Realtors.  What I got was a deep understanding of how to work new construction into the buyer tours and not risk losing a buyer to a builder. 

Once I became a broker, I trained agents in my company to do the same.  Sadly, they none had the "curiosity" sufficient to really focus on this aspect of buyer representation and several LOST buyers to builders, much to their surprise.  Sadly, all I could do was shake my head.  They all promised to make sure it never happened again, but sadly, it did.  Sometimes agents just never learn.

Lenn, I have lost two buyers this way since 1992. The first one said they could not wait for new construction and the other one said they did not want to come out of the area though I told them about the new construction . Then they visited a friend in there one weekend and went into the models and put a deposit.

Gita.  Lesson learned.  Don't listen to what the buyer says.  Make sure you cover YOUR bases.

When a buyer says that they don't want to wait for new construction, get them into the builder anyway and let them kow that new homes ready for quick delivery are likely.  With more loans falling through these days, more new home buyers are falling out leaving the builder with inventory homes and they can usually be purchased at very good prices for your buyer. 

With the other one, ask them to "indulge you" and visit something that they might want to consider.  If you have a good relationship with the buyer, they'll take the tour with you and you can get them in and get them registered.
