Bloggers Beware! Lawsuits cost big money....

A Hennepin County Minnesota jury awarded $60,000  to an ex-community leader involved with the Jordan Area community Council.  John (Johnny Northside) Hoff told the truth about Jerry Moore, but the fact that Mr. Morore was fired by the University of Minnesota the day after his post appeared to a readership of 300 to 500 people made the jury decide that it was libel. 

It is unfortunate for those who believe in First Amendment rights and free-speech, but it does come down to "who does the jury believe." 

You can read the article here in the Minneapolis Star-Tribune, but, you know I have an opinion. 

I would venture to say that while the falsification of evidence would make it a slam/dunk, the fact that the allegations proved true would make me side with Mr. Hoff.  After all, I believe he was just trying to inform the public of specific misdeeds. 

Feel free to weigh in.  You might be able to change my mind.

Suzanne... perhaps if this fellow had listened to his mother more closely... when she told him about "if you can't say anything nice... etc"... he would not be having this problem.  Just a thought.

I would have to side with Mr. Hoff. I think though he would have been better off sending a letter or having a meeting with the dean of the university or the head of the staff or department before going public in this manner.

It's about being the most believable...who markets their case the best.  We are marketed to all the time and if you get your point across, you win.  Just look at advertising.  Even with all of the disclosures in the all the pill ads (I don't know why anyone would base taking a prescription drug based on a slick TV ad)...they must work or the drug companies wouldn't out them out.  Or how about the Marlboro Man TV ads... Truth has very little to do with it or why people decide to do what they do.

Hopefully the decision will be appealed. Regardless, legal defense is very costly.

What a curious circumstance. Isn't this the same risk journalists run? Or traditional media outlets? Even if the paper gets the front page wrong, they print a retraction on page 13. I need to click through and read.
