Is your Will up to Date?

I have an Agent dealing with an out of state seller. He is handling the estate of his wife's ex-husband.

Wife ex-husband you ask.

When the wife and her husband divorced, the husband made a Will, leaving everything to his kids. His business, house, land, everything. Two years later he remarries and NEVER changed his Will. Then he dies. According to his Will, everything is left to his kids. All under age. So guess who's handling the estate? Yep, new husband.

First priority, kick new wife out of the house so he can sell it.

Second priority, sale off the business, and sell the building.

What a mess. Greedy, Greedy, Greedy

So is your Will up to Date? or do you want your Ex's new spouse handling your Estate?

How sad for these kids.  A will is very important in that your wishes be carried out.  So think of what cold happen and act appropriately.

Let me undertand this, he was married only 2 years and he is leaving to his kids from first marriage?  I think that is right. The will should protect his kids. Am I missing something? Just a thought.

Tamara, The home he lived in with his new wife. She got kicked out. he bought it after the divorce but before he was married.  She worked and helped pay the bills. A trust for the kids probably would have been better.

OUCH, that certainly could be a sticky situation for sure! I certainly wouldn't be on the receiving end of an ex-spouse, especially one that doesn't sound like that was a friendly divorce.
