HUD has just issued a final rule prohibiting the use of down payment assistance programs where a seller or other interested party (agent, lender, builder), places funds with a non-profit to facilitate the borrower down payment. This is effective as of October 31, 2007.

Allison - As long as they have it available I intend to try to use this as an option for my buyers and sellers. Nowadays you never know what they will change with guidelines from day to day.

Best advice I have is just to work with what we have today and do the best we can for our clients as the guidelines change.

Have you ever used this program? If so, what was your experience?

I have used a similar program called DP funder (www.dpfunder.com) and it worked out OK. I made sure to ask my attorney to review all of the paper work ahead of time which is a good idea for anyone looking to use this other down payment service.
