COMMUNICATION and DISCLOSURE are the most important things to remember in a Real Estate Transaction.

It never ceases to amaze me that some Professional Real Estate Agents seem to forget this very important question when speaking with or meeting a potential seller/buyer for the first time.

Here's the question...Are You Being Represented By Another Realtor Or Agent ???

This very simple but very important question will save you your sanity, time, money and COMMISSION!

We all know that as much as we instruct and consult with our clients about NOT contacting another agent, for whatever reasons they sometimes get over excited and call the other agent anyway.

Here is an example on why this might happen...Your client wants to see a home they found on the MLS and doesn't want to wait for you to return from out of town or whatever (yes agents have time away from the job, don't they?); because in their mind this is the home that they want to buy and are excited to go look at it. So... they call the listing agent and schedule a showing.

The listing agent is so excited themselves because they haven't had very many showings on the property and it's about ready to have a birthday on the MLS ! Sure I can meet you at the property at xyz time says the agent. The potential buyers look at the home and say they are very interested but would like to think it over and wait for their BUYER'S AGENT TO ARRIVE FROM OUT OF TOWN BECAUSE OF A FAMILY EMERGENCY.

Now wait just t a minute says the LISTING AGENT. I drove almost 45 minutes to meet you out here and you said nothing about being represented by a BUYERS AGENT! The potential buyers said they forgot to tell the listing agent and what was the big deal anyway?

Listing agent is upset because he/she canceled from going to see their son's baseball game in order to try to sell their clients home. Agent feels like he/she has been taken advantage of by the BUYERS AGENTwhenever the offer comes and asks for a referral fee in addition to their commission. REALLY???

Fellow agents and friends, do you see what is going to happen next? Both agents are going to start making decisions from their personal feelings instead of WHATS BEST FOR THEIR CLIENTS BEST INTEREST! In the end everyone loses, especially the CLIENTS!

We as agents have a fiduciary duty to look after our clients best interest AND if driving 45 minutes is too far to drive and not try and take care of your client then remember this question before showing your sellers home...Are You Being Represented By Another Realtor Or Agent ???

It is always best to ask before you start showing, and even then they don't always tell you the truth.

Glad I live in rural area where 95% of our sales are list them, sell them. No confusion, kept simple. If you list lots of property, have a great selection in all types and price ranges, you just keep bring out properties that fit their wallet and have a sale. It's like your own MLS that you don't venture out of, or that there is not much not already in it.

Really good article Craig. I think most clients don't ever look at the "big" picture and often don't care if they step on anyone's toes. I know agents have to put up with an awful lot with some of your clients. I'm often asked from friends, why don't you become a real estate agent? I simply tell them that most agents get some nuts as clients and I just don't want to go down that road! I give you guys an awful lot of credit and simply put, don't know how you can stand it. Hats off to you Craig and keep up the good work. Without a doubt you are one of those agents who people are lucky to have represent them!
