Selling because of the creepy neighbor - what do you need to disclose

  • Your neighbor has a telescope directed at your living room (or worse).
  • He is standing on the porch staring at you every time you come and go.
  • He walks around the neighborhood at oddest hours.
  • She tells everybody the ghost of a 12 year old is wandering the premises.

These are just a few stories that actually happened to me as a home owner, potential buyer and broker.

Needless to say we did not buy the house next to guy with the telescope (was in plain sight..). The guy across the street from us was a retired night cop and was simply nocturnal, nevertheless is was annoying to hear him sweeping the street at 2:30am. The lady across the street from one of my listings told everybody coming near the house that is was haunted by the ghost of a child who hanged himself in there (a lawyer's letter put an end to this and after several Open Houses there with little traffic I could clearly say, nobody was there!).

Different rules of disclosure apply in different state. Nevertheless the basic principle is CAVEAT EMPTOR, buyer beware.

The haunting (if it exists) does not need to be disclosed in most states, sometimes only when asked. So make sure you know the state rules if this is an issue for you.

And the creepy neighbor? Can be a misinterpretation, the next owner might just love him, maybe he is simply lonely.

In essence: you want to sell because of something like this? Ask your broker or consult the state laws about disclosure requirements - so that it does not come back to haunt you.
