Beware of SB 183 NEW SAFETY LAW FOR THE STATE OF CALIFORNIA

Law SB 183 The Carbon Monoxide Poisoning Prevention Act:  Effective July 1, 2011

To all CA agents who might not already know , California's SB 183 carbon monoxide law will be required for all existing homes that are owner occupied or tenant occupied. 

The new law basically conists of the following:

1.  All existing single-family homes that contain a gas heater or appliance, fireplace or an attached garage must install carbon monoxide alarms

2.  Carbon Monoxide alarms must be either battery-powered or plug-in with battery backup.

3.  CO alarms must be installed outside of sleeping areas and on every level of a dwelling, including the basement.

4. Non compliance will be an "infraction punishable by a maximum fine of $200 for each offense."

  All other homes will be required to be compliant beginning January 1, 2013. Units can range in cost from around $15 - $100.  The plug in with battery backup seem to be the most economical. The model CO615 from "First Alert" cost around $30 each.

There can be penalities and fines if this is not followed! Failure to install these monitors can cost you a maximum of $200.00 per offense with 30 days to comply.  This bill is also required for Landlords or property managers of multi-unit dwellings intended for human occupancy. 

Some recommended places to have these monitors and where not to have them are:

1. do NOT place the devices in any humid areas i.e.  bathrooms or kitchens

2. DO place 10-15 feet of all bedrooms

3. do NOT place in laundry rooms but DO place outside these areas.

 Whether we agree with this law or not no longer matters, it has already passed.  Add one more law in the books for California! Let your clients know so you don't run into one more potential delay in a transaction.  Please research further if you would like, there are many informitive articles.

We have the carbon monoxide law here in Colorado and have had it for a few years now.  It requires they be installed within 15 of any sleeping quarters.  What if you fall asleep in the bath tub..... hmmmm.

Belinda,  Thanks for the warm welcome.  We are excited to see it pour!  Russel has been to kind tin helping us.  Its people like him and the others on AR who have greeted us so kindly and graciously that get us excited about being a part of this community.

What happens if I'm sleeping in the "dog house" because Heather puts me there, where does that fall?  I guess as long as there are no gas appliances out there, I'll be okay.

Lucky this new law will be a low cost one to comply with.
I just ordered a case of these detectors to install on all the homes we manage and was able to get the pricing
under $20.00 each.

"When you let the camel's nose into the tent, the rest will surely follow" is an old saying. Meaning it's just another way the "Nanny State" intrudes into your life.

The last time I looked, there's no way to enforce it because they need a warrant to enter your home. Can you imagine a detective going before a judge requesting a warrant to enter?

The judge ask what's it for? The detective will say that he suspects that you don't have a CO2 alarm installed. He will be tossed out faster he can say "arrest".

Another ridiculous law that cannot be enforced. Next they have a law to prevent you from being hurt if you fall down. Each room in the house must have a 3" layer of foam so if you fall, you don't get hurt.

Then they will ban all knives in the home because more people get injured or killed with knives than guns. You must buy all your food processed with a blender so there would be no need for knives
