Did You Know: It's National Make a Will Month?
I heard that June is National Make a Will Month. It was being promoted on radio in an ad sponsored by LegalZoom.
You may see a connection here in that LegalZoom's business is to get people to use their self-help services. LegalZoom is not a law firm and does not provide legal advice.
I saw this brief video from a company in England promoting the National Make a Will Month. Since United State law was based on English law, the principals are the same and if you substitue their use of the word "Crown" for government in the US, the principal idea tracks.
Now with those disclaimers in place, it does make perfect sense for anyone with real property (a house, condo, plot of land or acreage) or assets to have a will. If one dies intestate, which generally means without a will, or dies with a will that is defective, it is left to the government to handle dividing your assets.
But the state's procedures may differ from how you would like your proptery divided. Thus you need to make a will to describe who you want to get what of your property. Or in some cases, who is not to get anything.
I'm not an attorney, but like LegalZoom, I'm not giving legal advice either. Each adult with assets should have a will. Nobody knows when they'll be checking out so June is a great time to get it done if you have not already made a will. If you have a will, it wouldn't hurt to review to see if it's up to date and everyone you need to have included is there. And if things have changed and you need to drop someone, or if you have added or sold property, you have it accounted for.
When we help client's buy a house in Texas as Realtors® we have to discuss insurance for property owners. Of course, if you are borrowing to fund the transaction, one of the conditions is you have to obtain and maintain property insurance. So don't forget to make arrangements for what happens to the property should you check out early. (There is a more elegant way of putting this but, you get the point.)
Now for those with blended families, who gets what can become a very complicated matter. Give it some thought, but don't take forever. Get counsel, make a decision and put it in writing. Although it may be uncomfortable, you may want discuss what you want to happen with the person you want to be the Executor or Executrix of your Estate. National Make a Will Month makes good sense.
