Man bites dog? Homeowners foreclose on Bank of America!

Reblogger Connie Harvey
Real Estate Agent with Pilkerton Realtors

The news is always bleak when they talk about the foreclosures. I have personally dealt with many homeowners in the months before the process began, hoping to keep them out of the actual foreclosure. Working with the bigger banks can be brutal. They come across so heartless and cold. This is truly poetic Justice! I'm so happy Susan shared this!

In what their attorney calls "sweet justice", a Florida couple turned the tables on Bank of America.  The bank initiated foreclosure proceedings on them, even though they had paid cash for the home and had no loan!

The court ruled that the bank had no right to file foreclosure and ordered it to pay the legal fees and costs of the homeowners.  After 5 months of collection efforts and unreturned calls, there was no attempt by Bank of America to pay the judgment, so the attorney for the homeowners got an order to seize the bank's assets.

They showed up with sheriff's deputies and moving vans, fully prepared to take desks, furniture, computers, cash in drawers, or whatever they could to satisfy the debt.  The bank decided to pay up.

Sweet justice indeed!

It is a victory for the homeowner this time, but a small victory as we all get hurt by this as people dont pay, the banks wriote it off and the peole who do pay end up paying more... no one wins except the ceo who gets a bonus

Charlie -  I had not heard it but absolutely loved it! I can't imagine what the branch manager was thinking. And how crummy for him that he got hit when it probably wasn't his fault at all!

Scott - I don't disagree. The sad part is that they could start a foreclosure on a property that didn't have a mortgage with them. What's up with that???

Connie, there are some sad stories out there. At least these folks and their attorney figured out how to get their attention and be heard, finally!

Connie I wish I could say unbelieveable - but it's not at all.  Crazy stuff out there.  I am liking the creativity of this attorney and his clients.  The Bank got what they deserved - they should have just paid the bill and admitted wrong doing.  But had they all of us woudln't be watching this, now would we!
