You Can Ask...But It's Not Going To Happen

Wrong QuestionA few years back at a settlement I was a part of I was surrounded by a smiling Buyers agent and the Buyers Lender. They were being overly friendly to me as it seems they had a request they were sure they could talk me into. You see, the lender said he had to change the buyers loan program at the last minute to make it all work out however it required some 'under the table' assistance from the seller in the amount of a few thousand dollars. Hmmmm. To add to the drama the sellers were anxious to get to settlement as they had already moved and purchased a new home and really needed the proceeds from this sale.

Well I took the sellers into another room and told them that what was being asked was illegal. That all monies changing hands on a real estate transaction needed to be on the table and on the settlement sheet. Though disappointed at not going to settlement they understood and agreed completely so we told the lender and agent that when they could show all the money on the HUD1 that we would settle and not before. Then the sellers and I calmly left. Two days later the buyer, agent and title person came to us with all monies showing on the table and settled the property without the sellers contributing at all.

This past week once again I was surrounded by a smiling lender and a buyers agent, who was apprehensive more than smiling, and asked if my seller could write a check 'under the table' to the buyer after settlement. Seems the loan program the lender put the buyer in did not allow the amount of closing that we offered and he wanted the seller to make up the difference by writing a check to the buyer. Seems the lender was trying to save face this time.

Once again I said no and reiterated that it was illegal and that the seller would not do anything 'under the table'.  And once again the settlement took place without doing so.

The first time I was shocked to be asked such a question, the second time I was annoyed. To think with all the shake out in this 'new mortgage and real estate reality' that a lender still exists that would ask such a question annoyed me to no end. But...when I thought about it later I guess there are still some agents out there who would have agreed to such a request. After all the buyers agent must have agreed or I would not have been called into their little meeting before settlement.

So to all you agents and lenders who ask me to do such a thing now or in the future please know my answer is

'You can ask...but it's not going to happen'

Martha - the lender was smiling? That's the first clue, isn't it? (KIDDING!). I'm shocked when I hear of the "deals" that are going on, especially with short sales. Good for you!

Martha,  The sad part of this is that buyer's lenders and agents are still doing this because more often that not, they are getting away with it.   It's been said no one likes a 'snitch', but we need to preserve the industry's reputation by not allowing them to get away with it.  Caron

Well said Martha! I have had this question thrown my way before as well and like yourself I have said no way and sent them packing. I do not care if I lose the deal or not. I frankly do not desire to lose my license, nor cost my Brokers his license and in the process become a tenant of the State of California in their correctional system. Keep up the honest work!

Great post Martha- I would have asked that they put their request in writing.. for obvious reasons ;-) These guys have some brass ones and sawdust for brains.. Good for you in educating your seller and sticking to your guns

I would say nothing suprises me anymore but every time I do, something new suprises me.  At the end of the day all we have is our reputation and integrity and no one is worth risking that over.  I  like your comeback though, I will have to remember it for the next time I am faced with this type of situation.

Everything must be listed on the HUD to be legal.  Any "side deals" are fraud.

It's sad that fraud seems to be so widely accepted - but what do we expect when our lawmakers and industry leaders are pulling stunts all the time and getting away with it.

We should all have our own moral code. Sadly, many do not.

Wow, Martha.  Your graphic says it all!  Hard to believe that they would even ask, and very "interesting" that in both instances, the buyers were able to close in a legitimate and legal way after all....

The buyer's agent was not looking out for their client's best interest.

I used to tell prospective buyers that by signing with me to be their buyer's agent  "everything I did had to be in their best interest.....as long as it was not legal." It occured to me that the latter part was unnecessary because anything illegal would not be in their best interest."

(Still....maybe this agent should have said it to their buyers and the lender!)

I cannot believe, or I find it incredible that an agent AND a lender would ever even have the nerve/stupidity to request that a seller write a check "under the table" for anything.  And... if I were the agent to whom the request was made... I would have brought ethics charges as quickly as possible against both the agent, and the lender as well.

Their request was not only crazy, it was stupid.

Good for you! It's all about honesty, integrity, and looking out for the best interest of your sellers. Shame on the buyer, lender, and buyer's agent for even thinking about going down that path.
