What The Home Inspector Writes Can Be Significant

While sitting in front of a house I am scheduled to inspect, a junky pick up truck comes down the road.  He slows to look at me and reads the sign on the side of my SUV, pulls around the corner, gets something out of the back and carries it behind the house I am to inspect.  I pay no attention and don't see him again.  As usual, I am a half hour early to the inspection.

My client calls to say he's going to be an hour late.  I am asked to begin as it's late in the day, that the Realtor will arrive soon to let me in.  So I start on the outside.

Coming out of the rear shed (with hokey wiring, Christmas tree lights stapled to the ceiling, and something almost recognizable as a hot tub) I am confronted by the pick up driver.  I don't think he's the seller because I was told the seller had already moved to another state.  He demands to know who I am.

I smile and say that I am scheduled to do an inspection on this house.  Also, that he read the sign on my truck and is looking at the logo on my shirt as we speak.  Maybe he can't read?

He is unusually angry.  Too much so.  He is strutting around.  It's odd!

So I add, "Who are you?  Are you here because you know a home inspection is scheduled?  Are you here to unlock the door?"

"I'M THE OWNER OF THIS HOUSE!  AND YOU'RE NOT ALLOWED TO BE HERE WITHOUT A REALTOR!"

"Well, I like to arrive early and do the outside before the buyer arrives.  In this case he will be a little late."

"THAT'S IT!!  GET THE HELL OFF MY PROPERTY!"  He is just looking for any excuse to keep me away.  His peacock attitude is a bit much.

So I respectfully returned to my car, listened to a message from the buyer's Realtor saying she will be very late, and called the listing agent.  Explaining the situation she says she will be right over, but it will be 30 minutes or so.  She apologizes sincerely.  I think she knows this guy!

Not only is the inspection late, but that will put me into the worst traffic and I have a lot to do that night.  He has cost me big.  A few hours big.  I am now in a very, very bad mood.  Let's just say that I can hardly wait for the inspection to begin...

When the Realtor arrives she comes to me first to apologize and asks to introduce me to the seller.  Standing between him and myself, and facing him, she is explaining, probably mostly with her eyes, how important I am to the sales process and how he should be nice to me.  She says that I can make a "significant difference."

Translation:  this guy can make things really difficult for you.  You shouldn't be here.  You don't want to tick him off.  I can't see her face, but I know that is communicated non-verbally.  He nods his head like a little boy.

I am only smiling sweetly.  Instead I could:

Bat my eyes rapidly like Scarlet O'Hara
Make a silly face
Bob my head like a Joe Pesci wise guy
Look at him while rolling my eyes
Or anything else to rile him.  But I don't...

AND I AM SERIOUSLY TEMPTED!

She lets me in.  The buyer arrives.  The seller goes away at the Realtor's insistence.  The inspection went as I expected.  The house was a mess.

IT WAS GOING TO BE A REALLY, REALLY LONG REPORT.

AND MY CREATIVE WRITING SKILLS ABOUND!

My recommendation:  sellers really shouldn't drive from another state to attend the home inspection.  They shouldn't attend at all!  You might want to communicate that to any seller who thinks it is important to do that!  Because, after all,

WHAT THE HOME INSPECTOR WRITES CAN BE SIGNIFICANT.

Don't you love people who have no expertise in your area, but think that because they think something it must be so!?  I probably would have insisted that he call his realtor to straighten it up while we were there and if that wasn't possible to reschedule and have the seller pay for the reinspection from the HUD statement!

In my neck of the woods most seller's agents choose not to attend the inspection. Apparently, some feel there is liablity. I have had a couple of instances where sellers were at the inspection, but it is rare.   I do attend the home inspection as a seller's agent, but I keep my mounth shut.

Nothing surprises me in this business. Like Erica above, I too discourage sellers from being at home inspections. In this case, the seller, if he was serious about selling his home, should have been welcoming and helpfull to you, instead of kicking you out!

That is some story! That seller apparently doesn't understand the role of the inspector very well. I've been home when an inspector came before but stayed away from him, just being available for questions. Anything I did say was very positive... I know who I need to be polite to!

Erica - that is best practice from my point of view.  I don't know where any liability could creep in though.

Joan - here sometimes, and only sometimes, the seller's agent shows up at the end to insure the house is sealed up tight.

Donald - there were a few more things going on with this guy then I am revealing in the post.  He had another agenda.

Gretchen - I am almost always early and don't understand where the concept that I can't be on the property without a realtor comes from.  But, like I said to others in my replies, I think this guy had another agenda.

Jim - my post from two days ago was about this house.  I try to write things in an entertaining way and yet teach a principle at the same time.  However, in this case, it really, really was a long report!

I don’t care who attends the inspection. Who attends and what they do while they are there doesn’t affect the job I do. In fact, the more people the merrier, because I want all those witnesses if something bad happens and I ever wind up in court! I've even had a couple of Sellers crawl under their house with me, one up into the attic, and a couple up on the roof! It's their house. They can do what they want.

Since the purchaser pays for the inspection the Seller has no right to any of the information from the inspection unless the purchaser choses to share it with him.  Of course any requested repairs must be accompanied by the corresponding part of the report.

So if the seller wants to be there to answer questions if they come up, I tell him in advance that he will need to stay in a part of the home away from the inspection.  when they hear that they usually don't want to be there.

Michael - I don't know what I can do, but people do bring problems down onto themselves when the inspector shows up to recount what they did!

Russel - to me the inspection is a classroom where the buyer can see and hear about his new house.  Class is best when focused and I can direct the lesson!  When other chefs show up to throw salt into the soup, things can happen that spoil the recipe!

Pam - around here the selling agent and seller get a copy of the report if an addendum is created.  There really is no reason for the seller to be present!

Jay,

We had a similar discussion a week or so back. Anyone who pi--es off the home inspector, in the capacity of being the seller is a fool. We have to be objective but there are SO MANY different ways in which we can report things, what photos do we select, and that can all make a real difference in the look of a report.

Agreed Steve.  It is not that I, or you, would try to do somebody in, but information on the report and how it is presented is very relevant.  This guy's house pretty much mimicked his personality.

Hi Jay:

I always recommend sellers perform a pre-sale inspection for 1. they have an opportunity to address things before they become an issue, 2. they understand the inspection process 3. to make the sales process go smoother.

On the other hand doesn't sound like this seller would have been open to that.

I have had the privilege of reading your posts since I joined AR.  Your comments would be a benefit to the Buyer. You are professional enough not to punish the home that someone WANTS for the (mis)behavior of the Seller.

Maybe not Jennifer.  The house was PERFECT.  And those before inspections are very hard to convince people to do around here!

Thank you Lynn.  Of course there was no punishment, but the house is the house!  And I can influence people simply by picking one photo over another!
