Ventless Fireplace And VA Loan Requirements

 

I'm not quite sure when this became a VA guideline, but this is something you should be aware of.  Recently I was involved with a VA transaction representing my buyer when 50 minutes before we were all supposed to meet at the closing table the VA wanted one more document or else the loan wouldn't close. The VA wanted a written statement from a licensed heating and air conditioning contractor stating that the existing "Ventless Fireplace" was equipped with an approved Oxygen Depletion Sensor and that it meets local building codes or is installed according to the manufacturers specs.  I've done several VA loans in the past where this wasn't required so I was caught a off guard.  

 

We were all at the closing and it was Friday so the closing wasn't going to happen, but I did make a call and scheduled an inspection for the following Monday.  Actually we did have a dry closing Friday, funding was in place, but couldn't be dispersed until the last document was in.  Come Monday morning the HVAC contractor was at my buyers home, performed his inspection and handed me his written report...after I handed him my personal check for $99 of course.  I wasn't going to let my clients take the heat for this and the sellers...well I won't go there.

 

Anyway, I thought this was something you would want to know if you aren't familiar with it or don't do many VA loans.

Nick we do a number of VA loans and that is news to me.  Also if that was a condition it should have been on the Commitment Letter when the loan was committed.

One more thing VA does not review the loans while they are going through Underwriting, they review them after the loan has closed and submitted to them.  At that point they slap the Lender on the hand if they did something wrong.  So this leads me to believe that this was a Lender requirement and not a VA requirement.  VA was just a handy scape goat for the Lender to make an excuse for something that they require and forgot to put in the Commitment Letter when the loan was committed.

Just my opinion and we both know that my opinion and a couple of dollar might get you a cup of coffee at you local coffee shop :)

I think we're all going to see a lot more VA loans soon because of the volume of VETS we have. It's said that they waited until the 11th hour and stalled the closing for that documentation.

Here's one I can add to the list. Woman goes to the closing table to close on her house 19 years after her husband dies. Meanwhile, she had refinanced the property several years before she sold it, so the deed was changed at that time. However, during the closing, there was a telephone call and the lawyer walks out and comes back saying, "this house was originally purchased as a VA Loan, prove that your husband is really dead."

Nick - I was not aware of that VA loan requires "Ventless Fireplace" system. Thanks for sharing an important information.

Vent-less Fireplace/Heaters

1.  If the subject property is "Existing Construction" and has a vent-less fireplace, what documentation is required?

Chapter 11, Sections 11.12 of the VA Lender's Handbook directs the fee appraisers to report (under "Conditions of the improvement....." in the "Comments" section) of the appraisal report any permanently installed, or to be installed, un-vented fireplace or other un-vented space heater that uses liquid or gaseous fuel.

This requirement applies to all cases ("Proposed or Under construction", "New construction" and "Existing construction").  The Notice of Value must be conditioned per Chapter 13.

Chapter 13, Section 13.06, page 13-23, under "Other Conditions and Requirements" illustrates with an example the following conditioning of the appraisal report:

"If the dwelling will have a permanently installed, non-electric, non-vented fireplace or other non-vented space heater, the NOV must be conditioned to require:

  • The veteran purchaser's written acknowledgement that the dwelling contains a non-vented fireplace or space heater which has not been inspected by VA, and
  • A written heating/air conditioning contractor, that identifies the property and states that the non-vented appliance:
  • Is equipped with an approved Oxygen Depletion Sensor, and
  • Meets local building authority requirements, or is installed according to the manufacturer's recommendations if there are no local requirements."

Nick ~  Thanks for the heads up and no I was not aware of this issue they put on you at the last minute.  I knew there was a new law with rentals that they had to be installed.  I have never done a VA loan and if I get into one I know who to call!  Congrats on your sale and getting it closed!
