The National Do Not Call Registry has not affected Florida's do-not-call law. Florida intends to continue enforcing this law and accepts new consumer telephone numbers. The national registry supersedes portions of the Florida law that are less strict. Florida telemarketers would have to consult both lists to ensure that a consumer is not on either list before placing a sales call. The Florida law allows licensees to contact for-sale-by-owners (FSB0s) to solicit a listing, and this is still permissible only if the owner is not in the National Do Not Call Registry.

In June 2003, the Federal Communications Commission (FCC), exercising its authority under the Telephone Consumer Protection Act (TCPA), established a National Do Not Call Registry, The registry is a list of phone numbers of consumers who do not want to be contacted by commercial telemarketers. It is managed by the Federal Trade Commission (FTC), the nation's consumer protection agency, and it is enforced by the FTC, the FCC, and state officials.

The registry now has more than 149 million phone numbers. Numbers placed on the registry remain on the list for five years. Beginning in June 2008, if they do not re-enroll, numbers for millions of people will automatically drop off.

People can register, or re-enroll their home and cell phone numbers at the Web site or by calling 1-888-382-1222. Telemarketers must pay an annual subscription fee to access the FTC list to ensure no calls are made to protected numbers. The companies also must update their own calling lists every 31 days to ensure there are no numbers from the registry on them.

The current annual subscription fee for the list is $62 for each area code, with a maxi-mum cost of $17,050 for access to all U.S. numbers on the list. The Florida Association of REALTORS® offers the list to its members for no charge.

From year 2003 through fiscal year 2006, telemarketers have paid more than $59 million in fees to access the database. Most of the fees are used to support the do-not-call registry program.

The rules of the do-not-call registry cover the sale of goods or services by telephone. Political organizations, charities, telephone surveyors, or companies with which a consumer has an existing business relationship are exempt from the rules of the do-not-call registry.

A company may call a consumer, even if that consumer is on the registry, for:

  • 18 months after that consumer's last purchase, delivery, or payment, even if the consumer's number is on the registry, or
  • three months after that consumer makes an inquiry or submits an application to the company.

If the consumer asks the company not to call again, the company must honor the
30 request.

We have to register our phone number for Manhattan New York do not calls... We get a lot of phone calls on our cell phone from telemarketers!
