Sometimes when homeowners are busy remodeling and choosing the perfect tile, the fact that they need a permit is swept to the way side.   Commonly forgotten permits can certainly rare their ugly heads when it come to selling the home.   Why risk losing a sale due to local requirements not being addressed until you have a sale?  There is a possibility of safety or legal problems that may derail an otherwise smooth sale. 


Typically when a homeowner uses a licensed-contract they will not be involved in the involvement of getting any necessary permits as the contractor will do that for them.  However; when a homeowner tackles a remodel themselves or using un-licensed contractor a permit can be forgotten.  This could possibly create a problem later.  Each state has their own rules and regulations, so it is best to check into these things prior to remodeling.    The purpose of why we obtain permits is usually consistent; it offers the assurance that the work being done is acceptable and meets all safety codes.    Doing the right thing will help avoid problems in the future.  As in many things in life, if a permit is required and it is not obtained, there will be consequences.    There could be fines as well as having to have the work re-done properly.  Don’t risk it – get one if needed!


Sellers who disclose these items up front have less risk of their transaction cancelling due to an unpermitted remodel.   Some banks will not lend if there was never a permit used on a remodel such as an addition.   Where additional square footage was added and there was not a permit done, the property could be subject to legal action.    So, Realtors….ask the question….”did you get a permit for that?”  when you are taking the listing.  It is better to know up front. 


When might you need a permit?   When making any changes to the structure of the property.  Kitchen and bathroom remodels, additions, installing windows, electrical switches, replacing a shower etc…  There are not too many jobs that you do not need a permit for.  It is better to be safe than sorry!

In California, you need a permit for just about everything. And I always recommend getting a permit!

In Fort Towson you do not need a building permit to build a home or add onto your home.  Everyone should check with their local authorities to inquire if they need permits and how/where to get them.

Yes, I agree, definitely checking to see what is required in your area is a good thing.
