MASS TORT SCAM HITS DISTRESSED HOMEOWNERS

You are a homeowner in financial distress.  Likely you are showing up on the radar screen because you are delinquent. Maybe you are in foreclosure and getting lots of attorney "hire me!" letters.  You are looking for solutions.

Comes along an advertisement, probably a mailer but maybe a telephone call, telling you there is a nationwide lawsuit being filed against your lender for errors in the loan origination, or in the servicing, or in the foreclosure documentation.  They promise that "if you qualify, after a review by our attorneys," you can join the class action.  The next day, after your information has been "reviewed" you get a telephone call telling you that the attorney review determined that you are in fact qualified to be accepted into the litigation!

The promise from being in the litigation is a fast settlement with your lender for a reduction of principal, drastic reduction in payments, even elimination of the mortgage.  Just sign up with the legal document we are sending you along with a one time retainer fee of $5,000 to $10,000!

Thousands of people have fallen for this scam - usually run by attorneys or having attorneys associated with it. The most recently reported one was reported in the newspapers in the past week, and more state attorney generals are jumping on the bandwagon regarding these firms and suing them, shutting them down and putting them into receivership,

The papers have talked about a law firm in California doing this, but I have had homeowners come to see me about these in Texas as well.  These firms advertise and market nationwide.

The problem with the "mass tort" concept is that no attorney usually reviews the material and the real qualification of whether you can or cannot be in the "class" is whether you have the retainer fee.  In addition, this mass tort concept is not a substitute for a foreclosure defense to an already filed foreclosure lawsuit against a homeowner.

Homeowners - and their real estate agents - need to be on guard against deals that promise results. Class actions almost never have a retainer fee involved for being part of the "class".  Further, the laws regarding mortgages, although mostly governed by Federal law that pre-empts state law on the matter, still have local laws that may have a material effect on the management of a case.  Why would a California law firm be best to handle your Florida foreclosure? 

Be alert and rely on trusted advisors for yourself and for your clients.

Richard, I happen to attend such a meeting with a friend who was contemplating letting this type of company help him with his troubled loan. The presenter didn't much like it when he discovered that I was a Realtor. When he said there would be an upfront retainer fee for the service, I asked if he was familiar with with FTC ruling on MARS. Shortly thereafter I was kindly asked to leave.

Of course I reported my concern about their activity to the AG as well as other attorneys I deal with and my local colleagues in the business.

Richard, This was such a timely post as I just ran into one of these allegedly attorneys in Arizona that took a retainer for $650 from a distressed homeowner. This attorney claimed to have power of attorney for the homeowner which was later determined to be an outright lie. Thanks for bringing these scenarios out into the open where we can be educated. This is devastating! It's also the first time we've heard about it; props for letting us all know. We have access to a TON of homeowners in distressed situations and we plan on immediately reaching out to each of them to warn against the scam. Shocking, to say the least.

It seem like every week I hear about a new attorney scam related to forclosures or late pays. The latest here in CA is suing the bank for $1 whole dollar. The bank never responds so you get a judgement. In roder for the bank to remove the judgement they agree to remove your foreclosure record formy our report.

The concept of this type of thing sickens me.  Rarely, if ever, do the members of a "class action" receive anything.  The majority goes to the lawyers.  Your post is about scammers that use this as a ruse.  The first step to combat this is for people to understand that class actions, in and of themselves, are pretty bogus to begin with.  P.T. Barnum is rolling over in his grave ROTGLHAO.

Thanks for this post and your warning.

It's not prevalent in Ontario. In most cases, no retainer of any kind is required in order to join in as part of a class action.

Richard, this is a good alert. I'm glad our CA AG has shut down these scammers. If it's too good to be true, then it is. The sad thing is there are homeowners who have fallen for it, and will if they are not warned.

There was a firm doing something similar to this here in Orlando.  They used the name Weinberg or something like that but come to find Weinberg was just a good jewish name that somebody made up to make the scam sound more legitimate.

I like how the article basically says a class action is the same as a mass tort [it is not]. The article also says the main problem is there is no oversight, and the only thing to qualify a client is whether they have the retainer fee [money] so what if there are attorneys reviewing individual cases to assure they are, in fact, a good candidate for a law suit against xxx lender?
