I just read a featured post by Dan and Amy Schuman - One Question That You Absolutely Must Ask Your Clients.
And just a few days earlier there were a couple of posts about buyer representation agreements by Mimi Foster - An intense (and embarrassing) real estate lesson.
Texting is a great way to stay in touch with anyone. It forces a quick get-to-the-point dialog and it especially useful when coordinating meeting places, times, directions, landmarks...etc. BUT NOT WHILE DRIVING! Just an aside... I recently discovered the Google voice command on my Android phone. You can use it for most anything i.e. "Send Text to Joe, I'm running late, see you in fifteen minutes." It works!
It was very timely because we just discussed procuring cause issues, texting, and the impact thereof during a sales meeting. From time-to-time, depending on the situation, a company may decide to proceed with a procuring cause action.
How does this tie in with texting? Proof. A procuring cause action that is addressed with a stack of printed out emails, faxes, and hand written notes on listing sheets goes a long way to establish a case. We all watch CSI on TV and see how they readily access cell phone records and text messages, but that's TV. In the real world, to do that you need a subpoena. That's costly and takes time, however depending on the case it may be well worth it.
So, some food for thought about what you text and how you may want to additionally document communications with your customers and clients.
