This reminds me a home I sold in Paramount, California a few months ago. It was tenant occupied and the buyer was concerned about buying a home that had a tenant because he had purchase with the FHA program. One of the requirements for FHA is that the New Buyer occupy the home within 60 days of closing escrow. I assured the New buyer that if the tenant did not move out after serving them with proper notice, I would personally help him with the cost of hiring an attorney. All through the buying process, the buyer was fully aware that buying a tenant occupied property could be a problem. Upon closing the escrow, I immediately gave the tenant proper notice and to ease his mind I gave him the eviction fee before knowing whether the tenant was going to abide by the notice or not. The tenant move out without having to evict them and the New Buyer didn’t have to spend any money taking possession of his home. I told him he could use the eviction money for his moving expense.
