How a Portland Exclusive Buyers Agent SELLS!

Real estate terminology is about as clear as mud.

And for this very reason, people wonder how I can be an Exclusive Buyers Agent and also a top SELLING agent in Portland.

Question: How can I be an Exclusive Buyers Agent AND a Selling Agent?!?

Answer: Simple. I am the Portland agent who brought the buyer to the closing table AKA the "SELLING AGENT".

Don't Confuse "Selling Agent" With "Seller's / Sellers' Agent"

The Selling Agent is always the agent that SOLD the property. Now, the property could be SOLD by the listing agent to the Buyer as a Disclosed Limited Agent, aka "Dual Agent." In that scenario, the listing agent could also be the selling agent. But, when I sell the property and work on behalf of my Metro Portland Buyer clients . . . I am the SELLING AGENT!

A Property is Only SOLD if it has a Buyer

The listing agent works for the Sellers. The listing agent can only SELL the property if there is a Buyer. If not, the house remains UNSOLD.

Does The Listing Agent Bring In The Buyer?

In the majority of sales, the property is sold through a co-op arrangement. The listing agent is representing the sellers and a buyers agent is representing the buyers. When the deal closes it will be the BUYERS AGENT who is recorded as having made the sale, i.e., the SELLING AGENT! The below is from a sale I just closed recently. This is from the RMLS which records data of all the property that has been listed by an agent in the Metro Portland area. As you can see, the S/AGT: Carla Muss-Jacobs is recorded. The "Selling Agent" is none other than yours truly . . . and I am an Exclusive Buyers Agent. I haven't listed property or represented a seller for over 9 years. The SELLING AGENT is the AGENT that BROUGHT THE BUYER TO THE CLOSING TABLE.

What Can A Portland Buyers Agent Do For You?

They CAN NEGOTIATE FOR YOU! 

As you can see, the property above in which I represented the buyers, SOLD for $35,000 LESS then the ORIGINAL List Price.

Not only that, but I negotiated $10,000 of Buyers Closing Costs to be paid by the Sellers.

I know . . . not bad.

Ask YOUR "dual agent" if they're going to be able to "COMP" housing prices for you and tell you the Sellers must be smoking something from 2006.

I think it's always confusing to have selling agent be the buying agent. I don't know if we can reinvent the language of real estate, but it's almost worth the effort. All we accomplish now is confusing the public.

Hi Carla - We have very few exclusive anything agents here unless they are on a team. It just doesn't work for most of us to give up half the market for a title. I spend most of my time with buyers, because they take up a lot of time, but I always have listings, and most people who want to sell their homes here will by buying another one, so I am their agent for both transactions. But every market is different.

I have always hated to be in a dual agent position.  Good for you!  You should be a part time comic along with a sellers agent, and exclusive buyer's agent!

Carla - In all of the dual agency transactions that I have worked on with my borrowers, I have never once seen any of the dual agents do anything like that for my borrowers.  EVER!!!

Carla, great post and something that confuses a lot of people out here. I tell them the only "dual agent" status I will ever have is because I am licensed in both Washington and Oregon. I would never be dual on a deal, I can't truly represent the interests of both parties at the same time.

Carla I have seen in the MLS Dual Agent transactions $6million and no reduction? Why because the buyer was told " I have another offer..." well stated buyers who do not use you are leaving money on the table period!

Stellar post, and much clarification to get consumers out of the real estate jargon that is so muddy. There is much confusion between SELLER'S agent and SELLING agent and you've done a terrific job of making all that clear, plus pointing out the advantages.

Fantastic explanation for one of our most confused terms.  I actually don't even bother to use the term "selling agent" anymore because it is so confusing to non-agents.  It totally makes sense the way you explain it though!
