Hi Debb, Too Funny. Now I know I will date myself but I know that MoonDance from a 16mm film that my Dad owned and played for us little ones. Of course the older he got, the older we got and we would have to watch it as adults too! Because no matter how old we were we were still his little kids with little kids of our own. 

 

Very special time remembered.

Isn't it something?  I can't believe the dance moves, now I know where Michael Jackson got some of his dance steps for "Thriller."  And, the "we are still somebody's kids with our own kids," rings true in every family. Richard,

 YouTube alerts you and should leave a notation next to your video identifying the music and how it can be purchased. It will tell you  that you do not have to do anything else "unless" you are notified again in the future.  Most all parties involved ( my husband's a lawyer (not copyright) and discussed it with some of his lawyer pals) agree that people can use songs quite freely without fear of a lawsuit. However, if you were asked to stop using the music, for whatever reason, stop. Naturally, if you choose to use a piece of music repeatedly, say as your theme, that would be a violation. In that case, you should always purchase the music - it's the right thing to do.

There are several schools of thought about this in Active Rain. Some feel that any use of the creator's music is a violation and that we are licensed professionals who should honor music licensing. Personally, I've talked to many local musical folks and they pretty much feel that as long as they get an attribute, it can help sell their music. I never play a song in it's entirety and generally use the snippet that best sets the stage. I would also never sell a video ( ex:, instructional) if it contained copyright music. Fair use laws define when you can use copyright material.

Warner Music blocked the use of videos featuring their music ( at least they used to, not sure if they still do) and some folks actually disputed it as they fell under Fair Use laws.

Here's what YouTube says about Moondance and a couple of videos where I've used music that is recognizable.

 I hit the link entitled - "What should I do?"
"No action is required on your part. Your video is still available worldwide. In some cases ads may appear next to your video." 

They are clearly saying that it's fine at this point, if that message told me to stop using the music, I would do so in a heartbeat.

Bottom line, it's up to you. And you seem to always make good decisions.
