A Difficult Buyer Is One Who's On The Lam.....

An interesting memory in the real estate business was the day we did business with a buyer who was “on the lam!”  (that kind of lam doesn’t have a “b.”)  How many times have you written an offer to purchase and the buyer falls off the face of the earth? 

How can a buyer write a full price offer and then play Whitey Bulger?  This was a real situation.  We couldn’t find this guy.  He missed the p&s date; the mortgage commitment date passed; and closing was only a few days away. 

Needless to say the listing agent (from another office) threatened us every day and decided to put the home back on the market without any signed release.  I reminded her that the offer to purchase is a legal binding agreement and in force until after the closing date.  The home did receive another offer, but guess who surfaced a few days before closing? 

The buyer contacted us and the buyer’s attorney.  He had the cash to close, and close he did!!  The other agent and office were sued by buyer #2 (and rightfully so!!)  Our buyer never gave an explanation of where he was (and we never asked) but he bought the house, and that’s all I cared about!!

Hi Barbara.  Wow, nothing like a little added stress while preparing for the closing.  Makes you wonder, doesn't it?

Now there's a crazy story! Glad that your missing buyer surfaced in time to close - and can't imagine why the other agent would decide to just ignore a binding contract and try to sell the house again! (although poor second buyer).

Linda....that was very stressful.....all we could do is play it out....

Nancy....bad decision on the part of the listing agent....they deserved the law suit.....from what I heard, buyer #2 made a few bucks on that one....

Haha, very timely blog post Barbara, I'm dealing with this exact situation at the moment. I do feel for the listing agent and the sellers, so I'm in an akward position of having to try to defend a client who is bahaving badly.

Malcolm....it's out of your hands.....but just remember, the buyer may surface and be prepared to close....you only know as much as you're told about every buyer....you don't know his background....he may be on the lam for a reason but he may perform also....the listing agent will get over it!!!

Sounds like an acid-in-the-stomach period, for sure! I've had some buyers who didn't communicate well, but nothing like this guy. Whew!

i Barbara,

That was quite a situation to have to deal with..I feel for the listing agent but she did not have the right to move on with another buyer with a legal binding contract in the works!

Dorie....she certainly knows that now and will always remember it....it cost her some money and her office too.,,I'm sure they settled....

Yikes! That's a hair-raising situation...or maybe a hair-pulling one! Amazing that the buyer showed up just before closing!! Guess his story isn't really as important as the fact that he did show up to close.

Yikes,

 I tell my buyers once we are under contract we need to talk every other day. Been in the same situation that you describe a few times. Stinks for all parties involved!

You see it all in this business!  A very strange and thankfully RARE occurrence.  The listing agent should have disclosed the situation and accepted the other offer as a backup, subject to default and release by the first buyer.  Glad after all that worry you got paid!
