Important Questions to ask your Escrow Company


#1 What are your credentials, licensing etc.?

Are they licensed by the Department of Corporations?

Are they bonded by one of the state bonding agencies?

Does each employee have their background checked by the Department of Justice (including photo and fingerprinting)

Do they handle Residential, REO, Short Sale, 1031 Exchange, Commercial, Relocation and Refinance transactions throughout the state of California? (or your state).


#2 How long have you been in business?

How about your escrow officers, how long have they been handling escrow transactions?


#3 Where are you located?

There is strength in numbers, do they have conveniently located offices in or near your transactions area? Do you provide mobile notary services in case signing off a deal requires after hours or to be done outside of escrows office?


#4 What are their fees?

Do they discount for first time buyers and military?


These and other questions are important to avoid minor issues like delays in transactions up to major problems like fraud! Your choice in escrow companies can make or break your escrow-process experience. They have a lot of cause & effect on closing on time!


Oh by the way, in the state of CA, it's the buyers' right to choose Title and Escrow companies. Here's an excerpt from California Civil Code Section 1103.22:


a) A seller of residential real property improved by four
or fewer dwelling units shall not require directly or indirectly, as
a condition of selling the property, that title insurance covering
the property or escrow service provided in connection with the sale
of the property be purchased by the buyer from a particular title
insurer or escrow agent. This section does not prohibit a buyer from
agreeing to accept the services of a title insurer or an escrow agent
recommended by the seller if written notice of the right to make an
independent selection of those services is first provided by the
seller to the buyer.



This right seems to be often overlooked by listing agents in So Cal Unless it will kill the deal, I always state on behalf of my buyers, their choice of title and escrow in their initial offer, so at least they know they have the option.
