NYC attorney and landlord, James Harmon, is asking the US Supreme Court to rule the NYC rent stabilization ordinance (rent control) UNconsititutional because he is being forced to subsidize the rent of residents who can afford to pay market rents.
One of his tenants lives in an apartment at $951 and owns a home in Long Island.
Harmon's suit has been shot down by lower courts; however, The Supremes have ordered the city to respond to his petition in early Jan.
Harmon is no stranger to arguing before the highest court * he successfully argued a housing desegregation case in the 1990s. Harmon and his wife own a brownstone that was bought by his grandfather in 1949 and sold to his father a few years later. He has owned the property well before the rent stabilization laws and half of the 6 rental units in their building are required to be rented below market.
