Common ‘Mistakes’ or Blatant Disregard for Our Real Estate Industry?

There are Laws we learn in Real Estate School and that we PRACTICE every day as licensees.  I admit it…I AM ANAL about abiding by our Real Estate Laws and following our COE. There are no cutting corners in real estate for me and it irritates me when there are others that do….blatantly.

Common ‘Mistakes’ or Blatant Disregard?

Breaking the Law:  When one gets arrested, charged and convicted for drunk driving, doing drugs, not paying taxes on commission (In Hawaii we have to pay not only State and Federal Taxes but General Excise Taxes too!) stealing etc. you are not only risking your license…but will ruin your reputation. Being a law abiding citizen should not be a problem anyway.

Cutting Corners:   Initialing and/or dating documents ‘for your clients’ because you are too lazy or embarrassed that you made a mistake or missed something is a ”shame on you”.  Get off your behind and do it right.  In my book, it’s the same as forging and if it comes back to bite you in the butt…you can only blame yourself.

Unlicensed Activity: There are many friends, relatives and acquaintances who believe they can do a better job than we do. Ha!  Well, instead of ‘talking’ they need to take the proper steps to becomes licensed and give the correct information. Same goes for those claiming to be contractors or any other professional that requires licensing and they are not.

REALTORS® follow a Strict Code of Ethics:  I’m sure the majority do and bottom line is that if each individual lives by good daily morals and values then there will be no problem following the COE. Following our laws, rules in communities and our place of employment is just something that comes naturally. If it doesn’t then you have a problem.

Support our Real Estate Industry….

…..and just ‘DO THE RIGHT THING’.

It is a shame that there are so many out there that think the COE is just one big gray area to play in.  I am like you in that I think more black and white, right and wrong.

Hi Sally - I wish all real estate agents would subscribe to and follow the code of ethics required of a REALTOR®, and it takes only a few who don't to give us all a bad rep.  I have just decided that no matter how others conduct themselves, I will maintain an ethical business.

Hi Sally,

eliminate part time realtors, get a proper accountability system in place and require a realtor evaluation  by each client as part of the sales documents, to be forwarded to the licensing body in each state and province, with a 3 strikes you are out method.

Sally cutting corners only get you one thing and that is trouble, and unfortunately there are many people that never seem to learn that lesson.

In property management we see others cut corners all the time- even with large firms hiring non-licensee's to do their property management work while professing to be in keeping with the law and ethics.

You nailed it with the last paragraph. If you have a good personal moral code, you don't need a COE in writing to keep you on the straight and narrow. And if you don't... then no COE is going to cause you to do right.

I'll admit, there have always been a few points in the COE that do more to protect agents than consumers, so it is possible to "do wrong" while doing the right thing. But in general, follow the Golden Rule and you'll probably be fine.

Sally, Sadly far too many are unable to differentiate between doing what they do and doing the right thing.  It may be because they never learned the right way and common sense simply does not prevail because they have none.  It’s not ok to sign or initial for a client because it was missed.  I tend to believe in most cases is it blatant disregard.
