Raymond Kennedy has closed another AHMSI, American Home Mortgage Servicing, Short Sale in Illinois. AHMSI approved the Short Sale and released the lien on the property for a total payoff of roughly $129,000. Based off the amount that was owed there was over $40,000 loss off the original loan. The loan was forgiven without any deficiency attached. This allowed the homeowner to move on with their life and put them in a much stronger financial position for the future. ur state took a positive action no defeciencies on short sales.  The homeowner is released.

You are 100% correct about Illinois taking action on this and I am so glad you brought this up. I will be doing a post on this once I get some legal interpretation on the actual law and when it's fully in effect. The bill is currently sitting on the governors desk waiting to be signed. I am hesitant to post about this just yet because of the chance of someone reading my post that is not one of my clients and making a decision on whether to accept the Short Sale regardless of the tems layed out in the approval letter before this is signed and in effect. I don't want to mislead anyone into making a bad decision. I am a little cautious with this subject since it is so important for many homeowners. I have talked with one of my attorneys about this and the feeling is that this still maybe challenged by banks since they are legislating away rights that were contracted between two parties. I am crossing my fingers and really hoping this is going to become a reality. I am also curious on how it effects liens that are not your traditional mortgage such as a HELOC. From the way this reads it sounds like it would be applicable to both first mortgage and 2nd mortgage liens.

Thanks for bringing that up. Regarless of the result it's great to see a state take such a postiion and we all hope they are successful.
