4799 Nick Claire went under contract on November 22, 2011 with an Act of Sale date to occur on December 22,2011.
I represented the Seller in this transaction and although a clean contract and smooth inspection process went well for the Seller, it was not so smooth for the Buyer as we would soon find out.
The Buyers had toured the home during a November Fall Open House event in Clearfield Ranch held on November 20th. They indicated to me they were interested but already working with a Realtor in Lake Charles and would be giving their agent a call.
Only 3 years old , 4799 W. Nick Claire was in mint condition, and the inspection process was flawless. The Buyers approved and no repairs were needed!
The appraisal came next in Mid December and there were no issues. The issues that did arise were working around the holidays and the slow speed of the underwriters!
The Act of Sale Date was December 22,2011 and the Buyers arrived in Lake Charles with all their furniture relocating from Dallas, TX. With no word from underwriting when a clear to close would be obtained and Christmas approaching, the Seller agreed to an Early Occupancy Agreement. The Hold Harmless release was signed and the Buyer's agreed to pay the Seller $100 per day rent. An extention to the contract was written through January 6, 2012 which everyone anticipated would be plenty of time to close after the Christmas holiday.
As Christmas appraoched we waited for offices to re-open and underwriters to process the file. The Seller was promised a "Clear to Close" by January 6th. Every day the update that came was another 24 hours.....the clear to close was obtained, but not until January 6th!!
$1,900 later in rent fees owed to the Seller, the Buyers finally closed today, January 11, 2012 right down to the wire.
The reason it was to the wire, was a 9:00 closing could not be finalized until the "lost" Fed Ex Driver could deliver the Seller's signed documents to the Closing Attorney! After tracking and the loan officer making a special trip to the Federal Express distribution office and contacting a "supervisor" the package was retrieved and hand delivered by the loan officer to the Closing Attorney at 4:40 pm!
What began as a smooth transaction ended up going through unusual circumstances. Thank goodness for patient buyers and sellers!
