a "Transfer Disclosure Statement" will be required

When selling your home in Humboldt County, California, .  This several page form will ask many questions about the history and current condition of your home.

Historically, the form is filled out by the seller and presented to the buyer for their review and approval at the time an offer was accepted.

There is a potential new reviewer of the "Transfer Disclosure Statement".  That potential reviewer would be the buyer's loan underwriter.  In my opinion it is only a matter of time before it become common practice.

In order to satisfy any questions the buyers loan underwriter may have in regards to your "Transfer Disclosure Statement", take the time to explain in full any items that are disclosed.  If additional room is necessary, use a legal pad or better yet type it and indicate it as an attachment to the disclosure.

If you have questions about an item to be disclosed, DO NOT hesitate to contact an attorney that specializes in the field of real estate.  Making sure all the "i's" are dotted and the" t's" are crossed is a very worthwhile expense at this time!

It could mean the difference between closing the sale and a cancellation of the contract to purchase.

Dan,

Underwriters looking at the Sellers Disclosures would be something new here but I think you are correct as it is only a matter of time it will become common place. I am not sure if that will be a good thing though. Your advice is excellent as always.

I have had underwriters ask for Transfer Disclosure Statements in the last couple of years. It seems more common now. If it's a form that's indicated as a part of the agreement, they sometimes want to see them all.

Dan this is great advise and an excellent point about this disclosure.  Underwriters are looking more closely at the transaction, the documents so don't get caught with this one.  Thanks for sharing.
