Is the Apartment REALLY a 2 Bedroom?

There is a sinking feeling real estate agents get when we look up the history of a co-op or condo apartment we are listing for sale and see that our new client bought it as a 2 bedroom unit and prior transactions have it as a one bedroom. Obviously, two bedroom apartments are higher in value than those with one bedroom. However, using a den or alcove as a bedroom does not make the area a legal bedroom.

Generally speaking, a bedroom has to have its own door, a window, and a closet. That said, even if the owner hires a contractor to add a closet, you simply may end up with an illegal bedroom. All buildings have certificates of occupancy, and they specify the characteristics of the building. The reason for this isn't simply municipal hegemony; the number of bedrooms indicate the probable number of inhabitants for matters like utility usage, parking spaces, and fire safety. If a large building with limited parking has ten or fifteen extra "bedrooms" added over time without  management's knowledge, there can be a shortage of parking or quality of life issues the building was not designed to accommodate. That is why there is red tape or prohibition in legalizing a 2nd bedroom.

When owners and real estate agents list a 1 bedroom unit with a den or a junior 4 (one bedroom with a dining area) as a 2 bedroom, that information is out there forever. It remains in Multiple Listing Service  archives and real estate websites, and future owners of the unit who thought they bought a two bedroom and can only sell it as a 1 bedroom may be caught in the information undertow. This is a liability that is larger than any gain that the 2 bedroom listing might have yielded.

The pragmatic issue is that the current crop of buyers in this economy are very cautious, and do far more research than in years past. Moreover, a buyer needing a true second bedroom often turns on their heels when they see a 7' by 9' den or converted dining cubby being pawned as that second bedroom after viewing true 2 bedroom units. That does not foster trust.

Last year the Westchester Putnam Association of REALTORS (now the Hudson Gateway Association) began to actively stop member brokers from listing junior 4 and 1 bedroom units with a den as 2 bedrooms, and that did cause a backlash with some sellers who thought they owned two bedroom units. This was an unfortunate thing, but necessary to make sure that the integrity of the data going forward would be reliable.

The takeaway for consumers and agents alike is that a simple check with the management office can save future headaches and expensive mistakes.

Good point Phil, if the second bedroom is converted from a dining or random space, the sale price is not going to be the same as TRUE 2 bedroom.

Hi J. Philip - We see it quite often, perhaps because our MLS let us identify bedrooms as "non-conforming" - it's particularly common in rentals, where a basement bedroom with out a legal egress window is counted as a bedroom. Bad practice and a huge liability if it remains a rental.

That's a common problem here with condos, especially older ones.  A one BR with a den is listed as 2 BR.  I report them to the MLS when I see them.

Of course, owners figure, "Hey, my son sleeps here when he visits, it's a bedroom".

I see that in our MLS at times too. It's really important to get the facts straight before it is entered.  Misinformation is costly on both ends.

This is tricky.  I am always careful when folks claim to have another bedroom when I don't see a door or a closet.  I wasn't sure about a window.

This is a pet peeve that I have with single family home and townhouse listings in my Western Prince William County market as well.  It's annoying when you think you are going to see a four bedroom single family home and get there to see three bedrooms on the upper level and in the dark, dank basement, there's a den with no window and no closet.

I always tell my clients that the unit can get chopped up as many times with as many bedrooms as they want, but in the end they are still paying the same for price per sq. ft and the number of bedrooms is sometimes just a marketing term.

In expensive markets like ours, people try to pull the wool over other people's eyes but in the end, no one is that stupid.

We see it here, too, often with homes where they claim 4 BRs but it's only 3...very clearly. Yeah, the current family USES it as a four but that open den area is NOT a BR. And it can be a real blow when showing homes and you are confronted with unmet expectations set up by the MLS. Is the agent representing the home appropriately? Methinks not.

Phil, this isn't as much a problem in our area for condos, but it is occasionally a problem when an older house has a non- conforming bedroom - no closet.

The definition of a bedroom here does not include a closet.  It is simply two (to code) means of egress in the event of a fire.  One egress has to be a door.

J. P., I've gotten accustomed to looking at old MLS records, tax records and in person before putting anything on paper.  What I find a lot of the time is that the old MLS records are incorrect.  As a matter of fact, a lot of the properties have had remodeling done without permits.  So there is a lot more finished space than records show.

J.Phil~Boy is this ever important! I've caught folks passing off a loft as another bedroom and while we don't have the tenant/parking issues, it still can be unethical and realtors do it wrong OFTEN. And, like you said, it's out there forever.

Too many agents do not understand the definition of "bedroom."  I would like to see some of them try to spend the night in some of the rooms that they falsely advertise.   Their head and toes would both be touching the walls!
