MR. PROPERTY MANAGER I AM VACATING MY RENTAL HOME BECAUSE IT IS NO LONGER SAFE TO LIVE IN

PHOENIX PROPERTY MANAGEMENTIt was starting off as a normal day in Phoenix Property Management. I was dealing with the following items

  1. Collecting past monies
  2. Obtaining signatures on contracts
  3. Calling new tenants to set up showings
  4. Following up repairs were completed
  5. Listing rentals for the weekend

I received a call from a tenant from a single family home. The husband informed me that he was vacating the home due to unsafe conditions. OK This was news to me because I just sent technicians out to fix all the problems previously last month. This information was news to me. I started to inform the tenant that he had to write down his repair issue in writing. Then, deliver to me in person or by certified mail to make an official ten day notice. Well, this tenant said that they were following the Arizona Landlord Tenant Act and they were within their rights. Tenant hung up the phone.

Next, the wife calls me back in five minutes. She told me that they will be vacating the home by 4/4/2012. OK-you can do what you wish to do. Are you ready to suffer the consequences of your decisions? Well, she started to get angry with me. Finally, she hung up on me.

What can I do? They have not legally done anything wrong at this point. However, I have taken the following steps to lessen the blow to the investor

  1. Hand deliver 5 day notice at the residence
  2. Put the property back on the market for rental
  3. Inform my leasing agents property available for rent
  4. Track this property for the next several days
  5. Be ready for legal action

JUST ANOTHER DAY IN PROPERTY MANAGEMENT. DO YOU REALLY WANT TO BE A DO IT YOURSELF LANDLORD? I am sure there are other things to do with ones time.

I allow 10 days to 2 weeks BETWEEN tenants is my fixed-term annual leases to take care of ANY and all repair  issues with regard to the property.  I rarely take properties with a "list" of repair issues and fortunately, I don't have residents WARNING me they are leaving.

Monitoring the situation when residents have looked an issue up on the internet to fit their circumstances is all a property manager can do....be ready to act - get keys, change utilities, REmarket!

There was nothing wrong with the home. Tenant wants to get out of their lease because they purchased a home. Still have six months on the lease.

Harry, 

We ALWAYS write an early termination clause in every lease.  It's 60 days notice, pay through that time AND pay a two month rent penalty for leaving early.  The owners have the same right.  So far, at least 15 tenants have done this and ALL PAID the fee.  

If folks want out they will go, we just like to clearly spell out what that will cost them.
