Stigmatized properties

I know a couple who purchased a home last year and have really enjoyed it. They did find out recently that the previous renter had committed suicide- not actually in the house, but nearby.

What are the laws in your state about disclosing any significant things in the home, such as suicide, murder, ghost showings, etc.

In some states, this type of thing is not required to be revealed "unless asked." So my questions is...Do you as Realtors ASK listing agents about any previous issues?

I'd love to hear if anyone addresses this....

I have never asked the question of other agents but I have also not had my buyers concerned about these issues. I would ask if it was a priority to my buyers, but if it aint broken dont fix it.

I've never had the situation to come up, but would definitely disclose it I know about it.

In California you must disclose if you know.

I believe this has come up in Indiana.  I am not sure if the end result was having to disclose it, or putting the responsibility on the buyers agent to ask in their offer, etc..  I think it was necessary to disclose it...

I don't ask - Generally I wouldn't want to know this kind of thing.  Most people would be perfectly happy not knowing.  Great post - I going to watch the responses.

Ethics aside - if you know it - and don't disclose it - when the moving vans show up and the buyer finds out - guess who gets the call?

In Tucson, I see a lot of listings with agent remarks stating that someone passed away in the home.  I believe that certain cultures do not want to enter a home where someone died, much less buy it!  Disclose if you know - it's not like there aren't any other homes to show them, and then you won't get that ugly call Kevin mentioned above!

Al - I don't believe it's our duty to ask, but if we hear something from someone else, then we should. Suicide away from the house wouldn't stigmatize a property in my eyes.
