In Australia, they produce videos with strippers to advertise a house. In Manhattan, they don't use Lockboxes. Ever. In my market of Westchester County, New York, agents don't touch contracts- when an offer is accepted, we have attorneys do contracts -after inspections- and the process can take 2 weeks. That's how we do it here. 

In Canada, they pay with different money. Seriously. 

Get the picture? 

The way we practice our profession varies with state laws and local custom. We have a great deal in common across ActiveRainLand, and we all discuss it every day via thousands of blogs and comments daily on this platform. The one thing we try not to get hung up on is the logistical or procedural differences between Florida, Texas, Michigan or Delaware. 

If I call a seller to set up a showing in Armonk, New York, the listing agent would rain hellfire on me. One town over in Fairfield County, Connecticut, the showing instructions often call for calling the seller directly. It varies. All real estate is local. 

Yesterday, Jason Crouch posted a blog on sellers who decline showings to their own detriment. Whether they declined showings directly to the showing agent, via morse code, or through a series of guttural grunts, the point is that buyers cannot buy what they cannot see. And instead of seeing the point, some agents who know nothing of how they do things in Austin, Texas, decided to wag their fingers at the author for not doing things the ay they do things in Jersey. Or Kentucky. Or Fartville. 

That is sad on 2 levels. First, you don't judge Austin Texas with New York or Oregon practices. And second, it is a shame that there are members of this online community who don't know how to play nice in the sandbox. If you don't know already, Jason Crouch is an elder statesman around here. He runs his own firm, oversees a good team, and has forgotten more about overcoming adversity than  many of us will ever learn. But even if you see something posted by someone not named Jason Crouch, you should hold off on the judgment and invective, especially if the commentary is from a market you don't know. 

This is a nice place we have here. We treat each other with respect and good will. We also have a ton of fun. If you have under 50,000 points, you should read up on it

And before you lob bombs in a comment, remember that your local market is not my local market.

Showing protocol is different every where you go ..... here all appointments are made through the listing broker who then notifies you through your broker to ensure access information is given only to agents not any Tom Dick or Harry who calls.

Phil - I think this is one of the most important learnings to come from AR for me anyways - how differently real estate is conducted in different states.  The second is how much we have in common despite all these differences.  I missed Jason's blog post.  I'll go check it out.  Thank you for being the "voice of reason" on AR.

Phil, you're right real estate is local and the rules vary considerably especially from state to state. I've heard in New York attorneys write the contracts. Here in commercial most transactions are initiated and negotiated with a Letter of Intent. Depending on the complexity of the deal, an attorney may get involved in the contract process.

@Evelyn (#44) - in Florida we do not have to give it to atorneys to do closings but writing contract is sure a prerogative of attorneys. We can only fill in the blanks the contracts that are approved by FAR and some of them are approved by both FAR and Bar.

But if I write a contract, it would be an unauthorized practice of law

Always appreciate your opinion and your blogs Phil.  How properties are shown always seems to bring out the biggest opinions in people, I know how we do things in Manhattan with listing agents being present at showings seems to be a topic of much discussion.

Phil, great post, as usual! I posted a comment there, long winded, about how even here in my area it is quite different for each house. Electronic, push button, combo, no lock box, agents with no electronic keypads, call owner, call agent, just go and sell, list agent needs to accompany. In the northern part of where I sell, agents use fill in the blank contract type offers, which go for attorney review since we are an attorney state also. I don't touch contracts.

But, in all honesty, how MANY TIMES do I have to hear... but that's not the way its done in NY.... Or ... my attorney in NEW YORK told me NOT to sign your buyer broker contract. (grumble, groan and grumble again.... explicative removed here)

LOL, couldn't help myself.

The point of your post is well taken. And the point of my comment? Well, a bit of advice to those who didn't get it, READ THE DAMN POST AND COMMENTS BEFORE YOU COMMENT! You might just save yourself from looking like a fool.

But then again, as long as I don't look foolish....

Phil:  Yes... every market area has their own way of doing things.  It is strange... well, mebbe not... how each area has more than its share of agents who feel that the way THEY do things... is the way everyone ought to do them.

When I moved from the Cleveland area to the DFW market area in 1982... I was just blown away that... once I wrote an offer with my buyers... (we write our offers, fill in the contracts, etc) I had to actually surrender that offer to the listing agent... who presented the offer to her sellers.

In Cleveland... back then, at least... it was "normal" for the buyer's Realtor to write the offer, and then call the Listing Agent, inform them that they had written an offer... and then both the Listing Agent and the Buyer's Agent got together... in person... with that seller, with the seller and their agent on one side of the table, and the buyer's Realtor (not with the buyer there... whew) on the other "side" of the table.

The buyer's Realtor would then present the offer to both the Listing agent and the seller... and explain its "ins and outs" to them... and probably either get it accepted, or walk away with a counter.

So... when I came to the Fort Worth/Dallas market... I was appalled by the "control freak" mentality... at least that was what I felt it was like... when I started working the DFW market.  Yes, Brooklyn Ain't Austin Ain't Jersey Ain't Fartville.

By the way... just exactly where IS... Fartville?  I am guessing it is a small town in Joisey, actually.  Prolly Chris Christie's home town, is my guess... LOL.

Is Fartville really a place? I want to look it up... :-)  Phil, this is a great post and SOOO true. It seemed like some of the 'newer' agents on AR were saying some nasty things about Jason and how he runs his business. No matter who wrote the post, there was just a lack of respect for the author. My guess is that there are lots of people on Activerain who share their thoughts and perhaps get SLAMMED but we don't hear about it because their post didnt get the attention that Jason's post received.

Its important for ALL rainers to remember to RESPECT other bloggers. You dont have to agree with the things they say, but there is still a thing called common courtesy which should be expected. Name calling is certainly no something that should ever be tollerated.

After being on AR for some time, I find the variances in practice interesting.  I would never assume that the manner in which real estate is conducted here is the same . . . there.  I wouldn't even want to start off thinking that the norms for my market are the norms elsewhere.  I had to go back to Jason's post to read up.  WOW ... talk about folks gettng  tad unhitched by calling the sellers directly.  We do that here in our market for the most part.  Sometimes our showing instructions have "Call LA" but it's rare.
