HUD recently took steps to against three Loan Originators that were caught cheating elderly borrowers, by what they referred to as a "debarment". These three Loan Originators were caught pressuring elderly homeowners into doing Reverse Mortgages, and cheating them out of the proceeds.
We have "Flip Rules" today because of Con Artists taking advantage of elderly homeowners. If Con Artists like these three Loan Originators have now found a way to use Reverse Mortgages to cheat elderly homeowners out of their money, then maybe new regulations will follow to deal with that.
What I found very interesting was the way these Con Artists were able to pull this off. They were able to get the properties to over appraise well above the property value in order to obtain more funds. I find this interesting for a couple of reasons:
- First, how could they possibly accomplish that without the help of an Appraiser. So why were there no Appraisers mentioned in the action taken by HUD.
- Second, weren't the new appraisal rules (HVCC) put in place to prevent this type of thing from happening?
This proves to me that the new HVCC regulations are useless in preventing this sort of thing, and have only accomplished raising appraisal cost, and to make it harder for honest Loan Originators to do business. When, Loan Originators, Appraisers, Realtors, and Attorney's are conspiring together to con homeowners out of their money and homes, laws like HVCC can do nothing to stop it.
Cheating elderly people out of their hard earn funds, is one of those things that sits completly wrong with me, and in my opinion what HUD has done is not nearly enough of a punishment. These guys need to be made a real example of, by sending them to prision for a very long time.
