Short Sale Agent with Expired Listing....Oh, No, It's MY Buyers!

The one great thing about being sick for a while is that you have a lot of new material to work with when you finally recuperate.

But, this is one story that I didn't think I would ever tell.

The listing that my buyers have been waiting and waiting and waiting for expired yesterday as we were going to file an extension of the short sale contingency. 

I went to prepare the amendment, and I couldn't find the listing.  I finally had to pull up an old listing and found that ours was expired.  On the same day that we were going to file an extension!

I have written about this agent before.  Nearly a third of her short sales go expired or canceled.  Not good. 

So when I called her to let her know that it was expired, she really didn't know.  And, I had to call her husband who is also an agent to reach her although I had left her TWO voicemails. 

I didn't tell my clients because I didn't want them to fret.  However, it was still not listed by the time I left to show property this afternoon, and guess who called? 

I have set up a search for them which is still active and my buyer saw the new listing and freaked. 

So, I had a little explaining to do...smooth their feathers and tell them the story. 

The bank could have cut the listing agent out of the deal altogether for that faux pas.  But, now that I brought it to her attention, it is relisted. 

What a waste of her time.   With a simple amendment to the listing contract, all of that could have been avoided.  And, she wouldn't have had to resubmit the new listing agreement to the bank. 

So I suspect this will hold things up even further.  Unbelievable.

Suzanne, I have never had this happen but it easily could if we don't pay attention to our business. What a waste of time for you too trying to track down the agent and get it straightened out.

I have let listings expire intentionally, but I've never missed a date where a listing was due to expire. I don't care how many listings you have, that's just basic real estate.

Rich and Winston, my broker and I had a good laugh about this.  Really??????  And, there tag line is that they are AWESOME!  Awesome has many meanings, and I think they truly are.  Awesomely stupid.  Even their broker should have noticed.  So the broker isn't any better. 

Poor Jill...i know you do great work, sometimes things happen.   Ergo, this example. 

And, Debbie, she really should have know better.  That's why we keep these kinds of alerts on our phones...and in the file and on the database and on our task list and .....oh, I could go on.

Suzanne, I agree the Broker isn't much better....I start getting notices from the MLS ten days or more when my listings are to expire....Perhaps the agent and broker do not read their emails :)

I don't know how she could miss that a listing is expiring or has expired. Doesn't your MLS let you know. We get an email every day for seven days before the listing expires.

Suzanne -- first off, I'm glad you are feeling better.   I've had properties expire while my buyers have been in contract and I'm never sure why it seems to be a surprise to the listing agent.   As Debbie stated in comment 7 we are "alerted" to expiration dates --- it's definitely a head scratcher, that's for sure.   Good luck on the road to closing with this transaction.

Yes, and it is indeed frustrating when a listing agent cannot take the time to stay on top of the properties that they list............I think that it is inexcusable when it happens more than one single time.

Hi Suzanne - After 18 years in real estate, very little surprises me, but I can still get angry. What I find unacceptable is that behavior like this is tolerated - she's obviously a repeat offender and yet there's no way to limit the damage she is causing to her clients, and potentially yours. Phooey!
