Sellers: Help Your Agent Sell Your Rhode Island Real Estate?  

 
More often than not I find that sellers in real estate will withhold information (not intentionally) that is important for a good Fortune Cookies in Rhode Island real estateRhode Island real estate agent to have to market a home.  It is again not divulging necessary real estate information and having to 'tooth extract' the information from the sellers by leading questions.
 
You may have experienced the following scenarios...
 
- So there are no easements on the property?, says the Realtor after seeing a path on the property well traveled.  
     Sellers:  Well no, it is kind of a public right of way to the beach but it is on the side and doesn't impact our property at all.. 
     Realtor:  Who says it doesn't impact a buyers decision?  It needs to be disclosed.
 
- Are you conveying a Warranty deed on the real estate?  says the Realtor
     Seller:  Well it is...but I have a quit claim from my ex-wife for the property now...slightly different.
     Realtor: Well then you need to put down 'Quit Claim' deed not warranty.  Let the real estate attorney's sort it out.
 
Furniture will not be included in this Rhode Island real estate transaction, it will be a separate addendum between buyers and sellers, says the Realtor.
     Seller:  Why can't it be included in the purchase & sales agreement?  It would be so much easier.
     Realtor:  Neither the selling or listing agent deal in furniture negotiation.  We deal in Rhode Island real estate.  Furniture to be sold will be done exclusively between buyers and sellers without realtors involvement.  Hallelujah.  

- Title to the deed is just you, correct? says the Realtor
     Seller: Well actually my brother is on it but he is slightly incapacitated but I need to get him to sign the purchase & sales agreement anyway...I hope he does since I haven't talked to him in several months.  HUH?!
     Realtor:  Can you give me your real estate attorney's number so I can check on this before this becomes a problem with the buyers.
 
 
As a realtor this happens time and time again with clients and it is not meant to throw anyone under the bus.  What I hope it does is AWAKEN all who may be buying or selling a home that due diligence, sleuthing, taking nothing for granted and sharing information is an absolute necessity to give your real estate agent. Whether a buyer or seller be!  Your real estate agent needs your information.  Sellers: Help Your Agent Sell Your Rhode Island Real Estate.

Sellers need to be open and honest with their agents, the same way a good agent needs to be open and honest with their clients. It benefits everyone in the end. Ginny, I've noticed a trend locally where sellers will keep certain information close to the vest.  It takes a pretty determined agent to break through the smoke screen to get to the truth.  It helps everyone in the end.

Keeping them honest is important.  Using a checklist helps - We have a lot of these questions built right into our listing agreements and reapeted several times in other addendums.

Ginny surprises are never good in a Real Estate transaction.  It does not do any good to try to cover things up because somewhere during the process it will come to light.

Ginny, we need to know everything. When I sit down with a seller I tell them I'm going to be asking some personal questions in relation to the sale of their home. Then I tell them these are questions I ask every seller. In order to best serve them, they need to be 100% upfront with me.

Well I do have to say some of your clients have been more upfront than my experience has shown.  I believe I need to lay the law down at listing time for everyone's benefit...yes, it is true that people sign papers they dont' read and parcels of land that hopped into their plat/lot are something to understand.  I guess we all need to learn over time what is and what isn't?!  thanks!

The things sellers forget to mention are huge.  Most sellers forget that their brother is also on title and he needs to know and agree to the sale.

I have run into all of the above in my past...missing sibling especially...very frustrating for a listing agent as well as a buyers agent thinking the have found the right house for the buyers!

Ginny, great post. Morgan just wrote a FAQ post about if furniture comes with the property. In NYC, if included in the sale, the buyers may subject to taxes as well on those items not to mention we are not licensed furniture brokers!

Ginny- good thing you are a super sleuth.  And as for the furniture, if the final sale price includes the furniture it would seem that poses a problem since the lender is providing a mortgage for a house and property not for furniture.
