Help! Why Can't I do this?

Branding my web-site, I find, is quite the challenge.  The average consumer knows sites like www.realtor.com and www.zillow.com  by heart.  Definitely branded sites for the search for homes.

I now am working on branding my site, www.oakridgetennesseehomes.com, and I want to be the realtor.com of Oak Ridge Tennessee.

I asked my Broker, "Can I advertise my site and just the site?".   

EXAMPLE:  

www.OakRidgeTennesseeHomes.com

 

The answer is no.  I must have all the other stuff with it.  I am not advertising a house for sale nor am I promoting myself.  Just the site.  I feel that is the main thing a buyer is interested in when looking for a home.  They aren't interested in me or my company... at least not initially.  Buyers want a place to look for homes. 

So how is it companies like zillow.com and realtor.com can advertise their sites which have homes for sale and not be licensed and I, a licensed real estate professional, cannot promote my site without promoting myself and my company?

NOt sure I understand the question?  You just want to promote that site without attaching yourself or your broker to it?? 

If that is the case; I know most states do not allow that.  At the very least you have to put your broker and their contact info on it. 

When you have a Real Estate licence it is all about  disclose  disclose  disclose - so that a customer can never say "I didnt know this person was a Realtor"?

Hmmmm, I'm confused too.  I think that your broker is wrong.  If you wanted to put up a billboard that had nothing on it except, "www.oakridgetennesseehomes.com" on it, you should be fully within your rights.

 

What I think that he's thinking is that once you get to that site, it has to disclose that you're a licensed agent.

Correct me if I'm wrong.

Also, before you hold Realtor.com in such high regards, look into the relationship between NAR and Move, Inc. (the private company that gets to use our "official" site as it's own.)

Bob, that is exactly what I was thinking.  And, the realtor.com example, was just that.  I am not a fan of Realtor.com either.

I agree with Bob.  Your broker being right or wrong is dependent on the mode of advertisement. Your website should have all the disclosers. But just posting your webname be itself shold be fine in places like .. well here.  But if you are sending letters or other items out that attach your website with real estate then you are in the realm of disclosure.  (Well my 2-cents)

Anona- If I understand you right, here is my thought.  One of the websites I have is for home valuation/lead capturing.  I called my city office to find out what the city's rules were on advertising my website.  They said that being as it is not for a specific property, I cannot put signs up around town during business hours, M-F.  So, I said "what about Friday eve until Sunday eve?"  She told me that there are no rules on that.  So, call your city and see what their rules are.  Do your due diligence and there are usually loop holes if you search deep enough.  Just remember to stay ethical.  Best of Luck!

Scott, that is exactly what I thought!  To the board I go, then back to the broker.  I like my simple thought and I want to use it.  (as I stomp my right foot on the floor and pout).

I am now awaiting a response from my Board.  Then I plan on re-approaching the Broker.  It seems it may just be our company policy... not the way of the land. 

I am curious though.  Why not during the work week and weekends are ok?  Was that explained?

I bellieve a number of brokers reserve the right to approve of any web site, or material on that website that contains the company name and logos....One reason, a good one, is liability..The other, is to keep you from branding you as your own idenity....either way be careful, and just play it smart

Lance, Thank you.  Although this is a very short blog, I am surprised it hasn't gotten more attention. 

I am glad of the attention it has received as I have gotten a couple good ideas.
