West Virginia Texting and Driving Law Effective July 1, 2012

Real Estate Agent with Perry Wellington Realty, Adam Conrad, Broker WV0026375

Starting July 1, new cell phone and texting laws begin and West Virginia state officials say the issue of safe driving is at the forefront.

On July 1, 2012, texting while driving will be illegal and becomes a primary offense, which means police can pull citizens over and issue tickets for that offense alone.  However, hand held cell phone use while driving will only be a secondary offense starting July 1, meaning police officers must have another reason to pull you over before citing you, such as driving with an expired license plate.

On July, 2013, hand held cell phone use becomes a primary offense.  The penalties are:

  • First offense - $100 fine
  • Second offense - $200 fine
  • Third offense - $300 fine and three points on driving record.

Court costs are also included with all fines.

According to the new law, West Virginia Department of Transportation has 90 days from July 1 to construct signs alerting drivers of the new laws.

All I can say is “it’s about time”.  Although I’ve been guilty of this, I now pull off the road if I need to call someone or take an incoming call.

Are you still texting and driving?

I'll have you know that the texting was not too distracting.  It was when I added on answering emails and eating and texting and driving that it got too much.  LOL.

But seriously, I can safely agree that even the best of us are distracted by this and I have installed apps that allow for VERBAL texting responses.  1 is called VLINGO.  Check it out.  It is much easier to speak your response than to type it.

Are you still texting and driving?  If so... STOP IT!  Albuquerque is a total hands free city and they mean it.  Camera's and cops will catch you and you will pay the price.  No call or text is worth killing or being killed over.

Rebecca: This is a good law that should be mandatory in all 50 states.  Texting and driving is extremely dangerous.

Howdy and morning Rebecca

Rebecca my friend, here in New Hampshire there is no Laws banning folks from holding and talking on a Cell Phone as they drive. The reason for that has to do with all the Cops from all over the State and the Police Associations threaten to walk off, if a ban of driving and talking on Cell Phones was passed, because the Cops would not be able to do it. There was a ban passed on texting while driving, but the Police Associations and Cops said they would not enforce it, here agin it had to do with because it would keep the Cops from being able to do it. To me the Cops were and are wrong with their way of thinking. I see Cops talking and texting on their Cell Phones as they drive all the time.

Have a good one

Rebecca... suggested! Everyone should watch the video. It goes straight to the heart! This video should be played on television, Internet ads, in movie theaters, schools, and all public places to get the message across LOUD AND CLEAR!

Texting and Driving is dangerous and not worth the price you pay  - if it's the last thing you do - everyone on AR should pass this video on and click suggest.

As we were out and about driving on errands, I saw a sign on the 101 freeway that the fine for texting is $159.  Even though our phone calls come through the radio, on occasion we will pull over to give full attention to the conversation...I just hope that people get it.  A

Anita, I agree this is a good law and should be mandatory in all 50 states.
