What does a Contract of Sale require??  

In my area, it requires "BROOM CLEAN AND FREE OF DEBRIS".

No water needed. 

"CLEAN" is a relative term.  Unless the Contract of Sale requires that the seller hire a
"professional" cleaning service for the property prior to closing, introducing the "cleaning"
                           is just one more matter that can cause problems for one side or the other.

I've been working a very difficult sale that was supposed to close today. Unfortunately, it didn't.

My clients had already removed all their furnishings and were sleeping on inflatable mattresses. When the closing got rescheduled, they also decided to reschedule their housekeeper to do the final cleaning when there were no mattresses to work around.

cleaning ladyMy clients then remembered they had already scheduled the utility disconnection. I contacted the buyer's agent, who also happens to be the buyer. She told me not to worry. Her utilities were going on today. There would be a seamless transition.

I explained that my seller was leaving town and the cleaning lady would  be coming, so we needed utilities. I was assured there was no problem. You can see where this is going, right?

At 4:20, I get a call from a frantic seller. He had already taken the key from the cleaning lady and had totally forgotten. He wanted to know if I could go over and let her in. Sure, but it will take me 20 minutes to get there.

My husband and I hop in our car and head over. We arrive and the cleaning lady is sitting on a lawn chair under a tree waiting for us. It's 102 degrees here today and she's pregnant. We let her into the house and I ask how long it will be before she's finished. No idea but she'll call me so I can come back to lock up.

dripping waterWe hop back into our car and we're almost home, when I get a call from the cleaning lady. She's panicked. There's no water in the house. This is a 4,000 square foot house that needs to be cleaned for a final walk-thru tomorrow and my client is in a car driving to Maryland. I tell her not to worry, I'll take care of it.

It's now 5:00, I send a text to the agent/buyer and she sends a text that the water doesn't go on until tomorrow. So much for seamless transition.

We turn around. Sure enough no water. What else can we do but knock on neighbor's doors? I walk to the nearest neighbor (did I mention these are one acre lots?), no answer. Then I walk to the next neighbor whose yard is slightly larger than one acre. He's home and yes we can carry buckets of water to my client's house to clean.

Fortunately, the cleaning lady had brought two buckets so we fill those up. My husband carries the buckets across the acre lot to my client's house. Did I mention it's 102 degrees? We decide the best thing to do is just fill the sinks in the house so the cleaning lady doesn't have to carry the buckets of water back and forth. Great idea.

buckets of waterOnly one problem, the bathroom sinks aren't holding the water. That means, water will have to be carried back across a one acre lot several times to clean this house. Fortunately, the pregnant cleaning lady has a younger woman helping her who can carry the water back to the house for her.

After carrying several buckets of water for her, my husband and I decide we'll go to dinner and then come back to lock up. Thinking how long could it be?

We get back to the house at 7:45 p.m. After sitting in the car for about 15 minutes, I go in and ask when she'll be done. She thinks soon. We decide to wait.

At 9:15 p.m., five hours after we had originally left our house, she walks out the door.

The moral of the story...don't hire a cleaning lady to clean your house on the day of closing. Arrange it to be cleaned the day before, when you know you still have water and electricity.

Good morning Lenn,

Broom cleaning would not pass muster here..maybe for some but definitely not for someone with a 4,000 SF home!! Buyers expect and should get a clean, mopped down home! I've seen this happen more than once with utilities.

Broom clean is all that's required but I think a cleaning service would be more appealing..... most people have the bathrooms and kitchen professionally cleaned....

As you say, broom clean is a relative term!  When referring to a whole house, I suspect it meant something different to my grandmother than it does to me.  My neighbors sold their house a short while ago and had a cleaning crew come through before closing.  The house looked great!

This scenario was brought on by the sellers. Did they really think that the cleaning ladies were so stupid and incompetent that they couln't have cleaned around a few inflatable mattresses? Then they could have just touched it up before closing. Some people just create their own problems.

Lenn, thanks for the re-blog.

I did explain to the sellers that it only needed to be broom-swept. They insisted. The owner said that's what he would want so that's what he was going to provide.

I will tell you, the cleaning lady washed floors, cleaned windows, deep-cleaned the refrigerator, stove and oven, cabinets and vanities were cleaned inside and out. Not to mention, the regular cleaning of the kitchen and bathrooms. Did I mention, there were 4.5 bathrooms? She did an excellent job. All for $100.

I was actually thinking of having all my clients use her. She was that good. And it was one big house.

I have found more disappointment with buyers who request that a company be hired to clean prior to walkthrough because the seller will hire the cheapest service they can get "professionally".  It is rarely up to the standards of the buyer.

I recently departed tenant used the term "broom clean" in an e-mail requesting his deposit....his LEASE stated the cleaning conditions on move-out and my check-out letter to him stated the SAME cleaning instructions AND provided names of professional cleaning vendors....

BROOM CLEAN is a VERY OLD commercial term referring to warehouses and industrial property and needs to be REdefined and CLARIFIED for use with residential properties.

Broom clean is pretty basic... I have had buyers who wanted spic'n span but they understood, ultmately, what the contract stated.

The cleaning lady should be hired before they list the home for sale and then have her come in continually while selling to maintain the cleanliness of the home BUT NOT THE DAY OF CLOSING, for sure.

Lenn, working of how to leave the home at closing is same here in Denver.    But, it is true, broom clean has different meanings to different people.

Hi Lenn - Timely post. I'm sitting here in my office - not at the closing we were supposed to be having this morning - since the seller neglected to actually comply with the provisions we placed in the contract requiring a professional cleaning service and a professional carpet cleaner. It was a rental property, and on our walk-thru last night, we were greeted with one of the filthiest messes I've ever encountered. Now the seller and listing agent are scrambling, and my buyers have everything they own in a truck. It's going to be one of those days.

Lenn I had friends that just sold their home, and they went waaaaaay over board with the cleaning.  I kept on telling them that they just needed to broom clean, but they had to make it sparkle.  They shampooed carpets and very thing.
