I have some very close friends in Texas who are attempting to sell their home themselves.  Of course, I've given them the reasons why it's best to have an agent.  And, frankly, I believe it's all about the almighty dollar for them.  But here's the thing that I cannot believe.  They said they found a company in the Dallas area that will post their listing to the MLS for free.   FOR FREE!?!?

Ok, so I don't know what business practices are being using in the DFW area.  I know that here in Baton Rouge we do have business practices that range from very small fees up to much higher fees to put a listing in MLS and represent a client.  There's definitley a healthy range here.  But "Free" doesn't make any sense.  In order to belong to MLS you have to pay fees, so how can anyone do it for free....

 .... Unless, it's not really the MLS?  My suspision is that there is some company out there claiming to put people's listing on the "MLS" or something that they conveniently call the "MLS" but it may not be the same database that agents actually use and search.

To all of you out there... are you experiencing scams from outside companies claiming to be affiliated with "THE MLS"?  What can we do as REALTORS to protect the quality of the term "MLS" so that people are not "had" by cons.  And, am I overreacting?  Maybe there's no harm in it for my friends if it's free and it's a con, but there's definitely a perception that the home will be "in the MLS".

Oh, and just in case there's any question about my use of the term MLS I do not mean Major League Soccer or Minor Listing Service.... nevermind - I think you know what I mean.

Bridget, since I am a REALTOR in Dallas and the DFW area I would be curious of the name of the company. Sounds fishy to me. I know there are limited service brokers that for say $400 will enter your info into the MLS. For free sounds very weird to me if not untrue.

Thanks, Gary.  I suspect it to be untrue as well.  I hope some other folks from your area will comment as well, just in case someone has heard something about this weird little deal.

Yep, sounds very fishy.  There has to be some sort of catch that either they aren't telling you, or more likely, they don't know.

Many members of the mls only work with buyers.  So they can put the listing in for free to the seller and only charge for buyer agent services.  No listing side.  I don't think there's any rule against it and they are members of the mls.  There's an mls offering to the buyer's agent...just no listing commission.  Then maybe there's a flat fee buyer agent fee and the agent who listed it for free is the one who has the buyer.

Perfect legal and OK with most MLS systems.  In fact it may be against the law to try to do something about it...free trade and all.

Ardell, Thanks so much for your comment.  I am not trying to undermine any other's business practices.  Just trying to understand how a business could offer this for free and still stay in business - what with the fees most people pay to belong to MLS anyway.  Now I understand.  If they work with buyers they have a way of getting paid and can still afford to put listings in MLS for free - kind of like an early closing gift!  That makes sense to me.  Not a bad idea for an agent who prefers to work with buyers and wants to target the FSBO's!

I read this and now understand from a Buyer Agent standpoint how free mls can be incorporated into a Buyer Agent commission for a for sale by owner client.  Never thought of that!  Thanks.
